So, when you have a band like Svartsot, who produces an amazing album like they did with Ravenens Saga, then every single member leave expect for one- over musical differences, why is that originalperson allowed to keep the name?
I can understand if half leave, maybe even all but two. BUT the entire band left at the same time except for one guitar player. To be frankly honest, I dont see what gives him the right to keep the name. Not the same band never will be. One man, in my opinion, has the right to carry on nthe band name if every single other person in that band left all at the same time.

well if no one else wanted the name, i guess it's fair for him to keep it even though it's not really the same band... especially if his future releases will continue in the same vein as the original stuff, while the other members' solo material wont (idk if that's the case here, just speaking hypothetically)

I would have to agree with mega in this one. Although do understand what you sayin Hollow, does seem that the lead or whoever came up with the name should take it.

I'd say it should go either by songwriting and/or who came up with it, as long as it's not a completely different sound that has nothing in common with the original sound. For instance, anything Tony Iommi does should be able to have the Black Sabbath name, same with Leif Edling and Candlemass.

Usually 1 person retains the legal right to the band name (like Tony Iommi for Black Sabbath) and either out of personal preference of studio pressure, they continue to use the name.
Studios usually prefer using the same name, since increased recognition usually means higher sales, and they frequently push the remaining member(s) to use the name.
