At the moment, I'm helping Hiro build an online webstore called JAPAN-TOY.COM. My job is to write the ToS, item descriptions, etc., but this is my first time doing this and I'm not really sure where to start.

Here's what I've got for the ToS so far:

(in the revision process following Mala and FFG's advice)
ToS
TERMS OF USE

Your use of this web site is governed by these terms and conditions. Please take a few minutes to review these terms and conditions. Your use of JAPAN-TOY.COM constitutes your agreement to follow these rules and to be bound by them. If you do not agree with these terms and conditions, please do not use JAPAN-TOY.COM.

Store Holiday
Our store closes every Tuesday and third Wednesday every month. We also have some irregular holidays. On those days, we cannot ship your products or evaluate your shipping cost.

Reserving an order

JAPAN-TOY will reserve your order for up to 10 business days. If you fail to contact JAPAN-TOY.COM within this timeframe, JAPAN-TOY.COM reserves the right to cancel the reserved order, upon which you will be notified at the e-mail address you provided.

When you are ready to complete the order with the due payment, please contact JAPAN-TOY.COM:

JAPAN-TOY.COM reserves the right to deny or cancel reservation requests at anytime if abuse of this policy occurs. Abuse of this policy entails reserving multiple orders and not completing the order with due payment within the timeframe stated above.

JAPAN-TOY.COM reserves the right to handle each order on a case-by-case basis.

Backorder
Out-of-stocks can occur, so if the item(s) you ordered are out-of-stock we will notify you via email, and then request your preference on whether to:
- Wait for the out-of-stock item to become available, and then send the entire order later.
- Send item(s) we have now, and send the out-of-stock item(s) later (Note, that you will be responsible for paying the extra shipping cost.).
- Cancel out-of-stock item.
- Cancel whole order.

Exchange Rate
All prices listed on JAPAN-TOY.com are in Japanese Yen (JPY).
Exchange rates for charging on your credit card may differ from the rate you saw when you ordered.

Shipping
Your order will be shipped via EMS (estimated 3 - 7 days shipping time). Your shipping cost will be based on the country, weight, value, and size of the package. You will be responsible for all taxes, duties, and any other fees that may be levied by your country. (Note, that if you would like your package marked as a "gift" when we send it, please let us know in the "Comments/Special Delivery Instructions" section of the shopping cart.)

At this point, we only use EMS (Express Mail Service) for shipping.
EMS Web Site: http://www.ems.coop/

All of the shipping options include a delivery confirmation (tracking number).

Please see the table for approximate shipping cost.

Please note that we are not responsible for any damage incurred during shipping.

Credit Card Policy
We may not accept orders by credit card from certain countries, so in that case, we will ask you to use PayPal or send an international money order the first time. (After you have shopped several times with PayPal, we may be able to accept your credit card.)

Unfortunately, due to licensing and/or safety restrictions, we may not be allowed to ship to your country. If this applies to your order, we will notify you via email and issue a prompt refund.

Cancellation Policy
If an order is cancelled after the order has been shipped, the customer is responsible for all shipping costs and a 10% restocking fee.

Return Policy
The purchase may be returned within 7 days after you received it. Items should be returned unopened or in original condition (cellophane wrap and/or tape still intact and unopened, including games and puzzles) with a copy of the invoice to JAPAN-TOY.COM.

A refund of the price of the item will be issued in the original form of payment used to purchase the item. Please note that this also applies to items received as gifts. If you return a gift, the purchaser will receive a refund in the original form of payment they used to make the purchase.

If you are returning the product because of a manufacturing defect, please contact the manufacturer directly for assistance and warranty repairs or replacements.

For all other problems (Examples: We shipped the wrong items, fewer products, etc.), please e-mail us at: toy@japan-toy.com.

Please contact us via email at toy@japan-toy.com prior to returning any orders.

Product Colors
We at JAPAN-TOY.COM have done our best to accurately display the colors of the products on our web site. However, we cannot guarantee that your monitor’s display of these colors will be accurate.

Product’s Package Condition
We will do our best to ensure your ordered product’s package is the best condition possible. However, damage can occur between shipping of the product from the manufacturer to us, to you, so we cannot be responsible for any damage to the package (including small scratches and dents to the box).

These Terms and Conditions May Change
JAPAN-TOY.COM reserves the right to update or modify these terms and conditions at any time without prior notice. Your use of JAPAN-TOY.COM following any such change constitutes your agreement to follow and be bound by the terms and conditions as changed. I basically looked on other webstores to see what kind of language should be used and what categories should be covered, and then I re-worded things and added our store-specific policies.

The the point of the language I used is to be so that even non-native English speakers can understand it, but I don't know how well I did at conveying what needs to be...conveyed. sweatdrop Make sense?

This is where you guys come in. I was hoping you could look over my ToS and let me know what should be changed/added/whatever, because I'm the only native English speaker working on this project and it would be a huge help to have someone I trust who speaks English natively to go over my s**t. Seriously. Tell me what sucks. I won't be offended. sweatdrop

Also, if anyone has any suggestions for our website, like things you would like to see sold, etc., please let me know and I'll be sure to inform store manager. 3nodding

Thanks, guys!!! heart

I can't guarantee anything, but I might even be able to convince my friend's wife, Kristin, to take a look at this. She's got really good business sense and I believe she's done a bit of business online.

All prices are listed in Yen because the aim of the website is to provide to the whole world. To find the price in dollars, I'd suggest using a converter. Here's one: Yahoo Currency Converter

Edit: Hiro's talking to the manager about listing an approximate USD price along with the Yen price, but since the exchange rate is always fluctuating, I'm not sure how that will work exactly.

Looks good!

The only thing I could suggest off hand would be broadening the "item packaging" disclaimer to include the items in their entirity, should they be damaged in shipping. Probably nit-picky, but you never know about some people.

Not sure if that's the place you'd want to put it, either, but I know several websites also include a little note reminding people that if their package arrives with the appearance of outward damage (bent, crumpled, etc.) they should contact the delivery agent prior to opening the package. Not sure about every country, but I know the USPS won't accept responsibility for a damaged package unless you open it in front of them.

It might also be good to make a disclaimer regarding lost packages, though it usually isn't an issue with EMS since there's a tracking number involved.

You could also say something about returned packages. If the USPS makes their scheduled number of delivery attempts and the person ordering isn't there to get the package and doesn't call to set up an alternative method, the package will often be returned to sender. In the chance of that happening, you might want to have an outlined company policy stating that the person ordering will have to pay to have the order shipped a second time, or can cancel the order with the 10% restocking fee (or however you want to do it). Doesn't hurt to cover your bases.

...This post is getting longer than I expected. D:

I could try! ...and fail. crying I suppose it's not a good idea. Alas, GS3 doesn't even have dual-language support DS release like the first two did.

I can still hope for goods, though. crying

Oooh, thanks for the advice. I talked to Hiro about everything, and I'll be adding those points to the ToS.

As for Gyakuten Saiban 3...Hiro said that it shouldn't have any region coding issues, but it is only in Japanese (as I'm sure you know). It's going to be re-released for Gameboy Advanced soon, so we should be able to stock it when it comes out. He's going to ask the manager just to be sure. I don't know how many GS goods there are, but we're looking into it (if you have any resource links to stuff, that would help too). I'm sure there's a good enough interest in GS to make it worth stocking them. 3nodding Thanks, Mala! heart

Skimmed over it, I'll read it in more detail in the next day or two. But, the first thing that I noticed was the 10 business day hold.

Maybe it's just me, but if I were you I wouldn't let customers hold onto my inventory for that long. That's 2 weeks..a pretty long time. No need to have your inventory sitting away somewhere not getting paid for during that time. I would severely cut down this amount. 3 business days would be more reasonable I think.

That way, if their paycheck is a few days away they can hold it...not holding it for 2 weeks while other customers who are ready and willing to pay have to wait for more items to come in. Then they'll just go to another provider and you've lost business. >_<

That's my first worry anyways. I'll go over it in more detail in the next couple days. ^^

You're most welcome. I'll see if I can think of anything else that might be of help. I went through a few other websites to look at points they made, but didn't see too much else yet.

Yeah, no English. crying I'd still be sorely tempted, but it's probably best to wait for a U.S. release...though I might try to get the Japanese version anyway, see how impossible it is to muddle through. xd
I went through Yahoo Japan a while back and found a lot of GS goods, but just being sold second-hand for the most part, so I don't know anything about current availability. I'll try to go through tonight and see if I can find anything else, or at least post up some links of the kinds of things out there. I know there are some really neat figures for most of the main cast, and a lot of little pins and other cute things. whee

Edit: Poops. Aside from finding enough doujinshi to make me cry ( crying !), I couldn't find much for GS goods on YJ today. This was about it for toy items. I know there's more, I'll keep looking. sweatdrop Edit2: I so want these. gonk

But really, any goods they can find to stock would be awesome. whee And yes, popular enough I'm sure they'd do well.

Thanks to your suggestion, we now have both Gyakuten Saiban 3 & 4 up for preorder (release date is April 12th). 3nodding

And I'm still working on the ToS revision. Should be finished by the end of work today unless I get stuck on something else. sweatdrop

In the meantime, I've got another question for you guys:

We've moved to the point where we want to advertise the site to various fandom-specific forums, but I don't know how to go about doing that without making us look bad.

I don't want to pretend with the "I just found the website and does anyone know about it?" spiel. It just feels unnatural and rude. I think I'd be annoyed and/or mad if someone did it on my forum (if I had one).

But saying I'm from that website and straight-out advertising still almost seems as bad.

How can I do this without making Japan-toy look bad? crying
