The header is all set and stuff is set perfectly in settings, with a preview, but will not apply to the shops form, and every once in a while for long periods, it wont apply at all. I also get a strip of gray under the navigation bar and above the ads

This will not replace event, holiday, chance item, or town headers.
The above is stated in the Header section, which explains why it won't work for long periods of time sometimes; the only way to get around it is just to use a Custom CSS for it instead of BG. IDK about it not working for Shops cuz due to the Event Header I can't see what you mean since BG won't overwrite Event Headers. Maybe Gaia uses a Special Event, Chance Item, or Town Header for Shops and that is why it doesn't overwrite it. If the Special Headers really bother you then just write a Custom CSS for it and apply it with an extension like Stylish.
