The Appeals Process
Below is the appeals process and how it works and applies to a person that was found guilty of violating the rules and punished accordingly. Any case can be brought up for the appeals process but it has to meet certain requirements before it can be heard.
Below is the appeals process and how it works and applies to a person that was found guilty of violating the rules and punished accordingly. Any case can be brought up for the appeals process but it has to meet certain requirements before it can be heard.
- A person(s) who feels that their punishment was unfair and can provide sufficient evidence to support the claim can submit an appeals claim to the Moderators to be reviewed only if the tribunal resulting in the punishment was done by the Gods/Goddesses.
- Note that fabricating any sort of evidence (i.e. Making stuff up) will not be tolerated and shall be punished accordingly with violation of Rule 14 of the Elemental Academy Rules and Regulations.
A person(s) that was punished by the Moderators shall submit an appeals claim to the Gods/Goddesses to be approved in a unanimous vote by the Gods/Goddesses.
- A person that is suspended or expelled from the Academy can appoint the Head Master of their element to act as a guardian for the person(s) suspended or expelled and can have the Head Master submit the appeals ticket in their place.
Upon approval of the appeals claim by a unanimous vote of the Moderators, the Moderators shall set a date in which the person(s) shall attend an appeals tribunal. Upon approval of the appeals claim by the vote of the Gods/Goddesses, the Gods/Goddesses shall set forth a date in which the person(s) shall attend the appeals tribunal.
- If the person(s) was suspended or expelled then the person(s) shall be allowed back into the Academy for this appeals tribunal date.
- In the absence of a Head Master to be appointed, a God/Goddess may be appointed for an appeals tribunal to be held by the Moderators.
If it is to be held by the Gods/Goddesses then a Moderator may be appointed in the absence of a Head Master.
- A person(s) that acted as their own Guardians during the tribunal process may not request an appeals claim.
- During this tribunal, any evidence of a mistrial or any evidence left out that would have prevented the punishment of the person(s) may be introduced but will have to be approved first.
It shall be upon the conclusion of the findings that the verdict set forth by the Gods/Goddesses in the earlier tribunal can be reversed and the event of the charge removed from the record of the person(s).
If the verdict was originally set forth by the Moderators then the appeals tribunal shall be held by the Gods/Goddesses of the schools and upon the conclusion of the findings the verdict set forth by the Moderators in the earlier tribunal can be reversed and the event of the charge removed from the record of the person(s).
