I just got told a few mins ago. They decided to Prosecute him with 3rd Degree Child Abuse Accidental with Harm.
This means that they are saying that though this was accidental, he still had hurt her and since she is a foster care child that it's more so considered abuse than if it had happened to myself or one of my other siblings that are legally his children.
Not sure when the court date is, and my folks are still trying to find someone to represent them as their lawyer for the case.
My brother-in-law thinks that they charged him with this so that they could get him to choose guilty instead of innocent, so this charge is pretty much majorly messed up. They just want him to say "I'm guilty, so lock me up and throw away the key".
He's not going to proclaim that he's guilty, because he believes that he's not. I believe that he's not, and niether does anyone else for that matter.

Yeah, they're trying to find all the ways to make him look bad when there are so many other ways to show he's good.

Yeah, so do I. But a couple of good things I am seeing from all of this is that, either way, my mom will still be able to keep her daycare (so they get to keep their income) and my dad won't be going to jail. With a charge like this, he'll just have to do community service.
He'll still not be allowed to be around the house when there are daycare kids, so that'll give him loads of time to do the community service as well as job search. He's even seeing this oppertunity to go back to school and get a degree in some sort of mechanics. He has a license for heavy equipment operator, so he already has his foot in the door for loads of jobs that are in need of people right now.
At the begining, nobody saw any good of any of this, but we're starting to see it. and like in my poll, we're not going down easy 3nodding

Thanks guys. I very much do appriciate the thoughts and prayers.
No word yet about a court date, but my folks have got it narrowed down to a couple of laywers. One is a really good friend of my bro-in-laws dad, so we'll see if he's available or not.

Your father might be able to submit a nolo contendere or Alford plea. An Alford plea admits that sufficient evidence is stacked against the defendent without asserting any actual guilt. It still has the same effect as a guilty plea, but it avoids having to say "Yes, I did this"
A nolo contendere plea is similar, only its use is more restricted, and it is usually used in plea bargains, where you do not contest the charges (that's what nolo contendere means) but ask for a reduced sentence (or no sentence) given your cooperation.
Obviously a lawyer is your best bet, but know that there may be other options than just saying "guilty" or "innocent."
