my husband has been UA for almost 5 months. from the navy. i've known about it. i leave for bootcamp in 27 days. how much trouble am i in and how much trouble is he in? can someone please help?

"UA" means Unauthorized Absents. At least, I'm pretty sure it does. I'm just a depper right now.

Also wouldn't he be a deserter by now? I'm pretty sure if it's more then 30 days then you are a deserter.

I can tell some legal mumbo jumbo about it. As long as he can prove that he has the "intent" on going back to the Navy then they can't prove anything against. That's what my SMI has told me about it. Now he gave a big "F" you and ripped up his uniform, left the country, etc. Either way he'll probably get court martialed.

As for you...since you know about it. You are an accomplice. Since you are in Dep you can also be court martialed as well.

Don't take my word to heart because this only information from my SMI and prior knowledge. Where's a JAG when I need one?

Ok this is coming from someone who is actually in the Navy right now. Once they find him, and they will, he will be court marshalled and probably kicked out with a dishonourable discharge unless they decide to send him to levenworth prison for desertion. As for yourself they can't do anything until you sign the paperwork to officially join the Navy. My suggestion is that you let your recruiter know this information up front before signing your paperwork that way they can't hold it against you later. Keep in mind though that if your not upfront with it then you can be charged with failure to obey a lawful order as well as aiding and abbeding a known deserter. I'm not sure if it is worded like that but I know they have an article in the UCMJ that covers that topic.

yes, your relationship with the man is sacrid but it wont interfear with your carear in the navy. it isn't your fault he is ma. they wont question you or court marshal you as long as you are'nt envolved phisicaly during your posted duties and time served. you are two different people and the navy realises that and understands thats. you'll be ok. the work things out. wink

hun, im a MMFA in charleston, in other words, im a nuke who got masted, right now, listen to me, you will be fine, your husband however, his fate is up to the co to decide, whether he gets captians mast or court martial, ether way he is looking at detuction in rate, loss of pay, time in the brig, and separation from the service with a dishonorable discharge

You won't get in trouble for his poor decision. It would be a different story if you were enlisted, but you aren't yet so don't worry. As for what they're going to do to him, well he's more than likely going to go to court martial, and (not meaning to scare you) could possibly face time in prison. After 28 days of being UA, he's considered a deserter. We are in a time of war right now, and that makes his offense even more serious. Desertion during time of war is no joke. Best of luck to you, and I hope you use his choice as a lesson to you. Don't make the same mistakes he has. The Navy is easy as long as you do what you're told and keep your nose clean.
