The 3rd District Court of Appeals ruled that the punishment the state Pharmacy Examining Board handed down against pharmacist Neil Noesen did not violate his state constitutional rights, specifically his "right of conscience" to religiously oppose birth control.

"Noesen abandoned even the steps necessary to perform in a minimally competent manner under any standard of care," the three-judge panel said. The decision upheld a ruling by Barron County Circuit Judge James Babler.

Noesen, 34, of St. Paul, Minn., told regulators that he is a devout Roman Catholic and refused to refill the prescription or release it to another pharmacy because he didn't want to commit a sin by "impairing the fertility of a human being."

The Pharmacy Examining Board ruled in 2005 that Noesen failed to carry out his professional responsibility to get the woman's prescription to someone else if he wouldn't fill it himself.

The board reprimanded Noesen and ordered him to attend ethics classes. He was allowed to keep his license as long as he informs all future employers in writing that he won't dispense birth control pills and outlines steps he will take to make sure a patient has access to medication.

The board also found Noesen liable for the cost of the proceedings against him — about $20,000 — but the appeals court ordered the board to reconsider that decision.

I had to giggle at this part: "The board reprimanded Noesen and ordered him to attend ethics classes."

But I really do hope more states follow suit with this.

Ah, sweet justice. I never understood how a pharmacist could just say "nope, you're not getting this prescription filled by me or anyone...regardless of the fact that it came from a DOCTOR who ordered it for you." That would be like a Jehovah's Witness saying that his or her patient isn't allowed a blood transfusion regardless of which doctor preformed it.

Since religious fanatics are so appalled by society and reality and everything that the rest of us are doing, and since they seem so committed to distancing themselves from society and reality as it is... why can't they just do it completely? If they hate the sinful, evil world with its horrible people, why can't they live outside of it? The Amish do it!

Furthurmore, since they hate it and want so little to do with it, why don't they stay the ******** out of government and try to live their pious little lives outside of society? Why is it that they can't convert by example instead of trying to impose a theocracy on us all?

Why is it that they can't convert by example instead of trying to impose a theocracy on us all?

I suspect that, deep inside, they fear their beliefs are more silly than they would like to admit. Safety found in numbers, in this case: the more people adhere religious fanaticism, the less ridiculous your ideology might appear.

They should make him pay the fine. It might serve as a warning to other 'pharmacists' who try to pull this crap.

I'm glad they made him take Ethics classes but I feel he should also apologize to the client for not meeting her medicinal needs.

Ugh especially since I know some girls when I was in high school that were on the pill simply for medical reasons, like endomytriosis (sorry if spelling is off there) which can cause a LOT of pain (my mom also has it).
