So, today, well yesterday melding into today, Hikari has found herself in a bit of a pickle.

I know, I know, most you will think "When is Hikari NOT in a pickle?"

In any case, I will stop talking in third person. K, so I go to the doctor yestreday because my wrist has been hurting terribly, and its steadily gotten worse over the weeks until suddenly I can push myself up on it or grip anything without being in excruiating pain. So I go to the doctor. Who informs me that WHEN I FELL IN THE ICE AT WORK (<---- note emphasis) I broke my wrist in 2 places. So he tells me I must file Worker's Comp.

So I go to my boss, and then my boss' boss, then my boss' boss' boss who are all avoiding me like the plague and informing me to basically go to hell (in not so many words).

So I call,Workers Compensation Office in the Dept. of Labor to ask the basic questions of what to do.

Here this will be easier.

1/23/08 6:00-7:00pm - stopped @ Hollywood Video told Alisha that Dr Amann said to let her know I need to file a workers comp claim. She said she didn't know how to do it, that I needed to talk to Ed.

1/24/08 1:50pm - talked to Ed told him I need to file a workers comp claim he said I need to call the Worker Compensation Office.

1/24/08 1:54pm - Spoke with Ms. Fairbanks re: workers comp she said business was suppose to file paperwork to report a work injury. I explained to her that my work would not speak to me aboutworker's comp, that they were avoiding me. I informed her of previous conversatio with Ed, she said they were not supposed to leave it up to me, but that the business was liable. Said she would call and speak to Ed.

1/24/08 1:59pm - Ms.Fairbanks called me back to inform me that Ed claimed I asked him how to file for unenployment and not Worker's comp. She informed me she told him to help me file a worker's comp claim. She said many employer's try to get out of a Worker's Comp claim by saying they know nothing about it. Told me to call Ed back and speak to him about filing the claim throuigh Corporate. She said to call her back if they give me any grief or problems about filing claim.

- talked to Ed again about filing workers' comp claim. Call Ed back per istructions of workers comp office. He stated he had spoken with Alisha and "neither one of them knew anything about a fall at work". He asked me to explain what happened, I did. He asked if it happen prior to you "cloking in" I told him yes as I was on my way in the door prior to clocking in. He said he didn't think they were liable, I told him my understanding was it would be a workers comp claim. He said he was in Roseville, Ca with owner "Bruce" he would ask Bruce what the company liability was and would call me back today.

1/24/08 2:20pm - Called back to worker comp office 801-530-6834 left msg for Ms Fairbanks to call me and advise what I should do next.

1/24/08 3:20pm - spoke with Ms. Fairbanks re: my phone discussion with Ed. She exlplained to me that neither Ed or Bruce can decided whether or not they are liable for my on-the-job injury. That they are required by law to submit a First Report of Injury paperwork, the the Worker's Comp Office decideds if they are liable. And that Ed is not an expert onWorker's Compensation Law. She told me to call her back once Bruce and/or Ed called me back.

Just keep on them and don't drop the issue, it's about all you can do at this point. I'll go munch on that pickle now.

According to one of the girls I work with who got worker's comp if you're on your way into work or on your way home on the companies property in your usual manner they are in fact liable for any injury you receive. That is whether or not it's their fault even. She was hit by a car and Walmart had to shell out money for worker's comp.
