I swear the november MC wild things (roc) looks exactly like a chocobo from the final fantasy games.
I thought it would be a dinosaur item, but oh well.

I thought so, too. My initial reaction was "Jesus, that's a law suit waiting to happen."

Roc's are mythical birds, same as phoenix and griffin... so, no copyright infringement, since they clearly call it a Roc

But do Roc's have the distinctive blue eyes I wonder. wink
I think the shape of the MC - which my avvie is modelling - is too like a Chocobo for it not to be.
then again, Square doesn't seem so bothered with sueing people; most Japanese creators are the same (they allow fans to create Doujinshu after all without any sort of punishment, in fact they seem to be encouraged).

That's if you're going by words.
Were let's say, the design of a chocobo copyrighted, and it appeared, weather true or not that gaia copied that design, then it would be copy right infringement still.
I'm not sure is Square Enix uses the American Copyright system though, otherwise it would be copyrighted weather it be registered or not. though it's hard to raise a lawsuit if it isn't registered.
Where I come from they make you seriously learn about copyrights.

When I first saw it I thought it was a chocobo too. But Mamarita has a point. They are mythical birds. So maybe they just made them to be that and they just look a lot like a chocobo.

With all the sponsors that GAIA now has, who is to say that they didn't get permission to mimic a Chocobo - but the announcement does clearly say ROC!

While I must agree it looks A LOT like a chocobo... do you really think Gaia would be dumb enough to do something that might cause them a law suit? xd I think there won't be any copyright problems... they're smarter than that

I dunno, with some of their customer service that could be argued.
