Heath Ledger's Joker comes from the Year One comics done by Frank Miller, as well as several other aspects from the television series and a few of the other series.
Jack Nicholson, from what I can tell, was more from the old television series and perhaps some of the beginning comics.
While a good Joker did he be, he never hit on some of the Joker's key points that Ledger seems to nail spot on. His complete obsession over Batman, for example, on top of being uberly-psychotic, derranged, and more chaotic.
Nicholson seemed to be more of a schemeing sort. While that was an aspect to the Joker, it wasn't his whole persona. If he had been more like his role in the Shining, he would have been better, but he just didn't bring that aspect into his role.
I really could debate about Batman all day. My brother and I are avid fans of the series. We collected the comics for quite a bit, read the novels, and liked to compare him to other superheroes and how he was superior to them in alot of aspects.
