I dont think you shold pay him for the simple fact that
A: Thats not what you requested
B: It breaks the ToS
C: You cant even tell that it is your avi..
I mean it is a good drawing

But if it isnt what you asked for then you shoudlnt pay for it.. Or you could ask him to change it..
