I've thought about it being Neal as well, because of the ability this person has to avoid cameras and be stealthy. I don't know if it is or not, and it depends on where exactly all the pictures were taken from, too far away and he would have set off the anklet.
Yes, actually. Matt can sing. There is one or two clips of him singing as bonus features on the season one DVD. He sings a song with his MP3 Player/I Pod, which he didn't seem to notice was being recorded until he was finished, looked up and saw the microphone. Then he was goofing off with Tim and singing another time.
Also in an interview, the cast talked about how Matt would sing between scenes and get songs stuck in their heads.

I don't think it's Neal, I just watched that scene where the mystery man first appears his hair is shorter and darker then Neal's. In fact I think he might be younger then Neal. Right now I'm paused at where you see Diana's picture. Diana had just mention she put the face through facial recognition if it was Neal they would know. Though for some reason he reminds me of Peter... Long lost evil twin brother? mrgreen
