Most artists on Deviantart allow others to post anywhere, as long as they give credit for the picture (and their deviantart account name so others can visit it there). If it's from Deviantart, he doesn't need permission as long as he copyrights it to the artist. As an artist myself, the only thing he did wrong was not post who the picture belonged to. And maybe the whole thing about getting permission thing...


Well, the thing is, before I opened up my artshop on Gaia recently, I read through the rules that regard the use of an artists work, and all the other related topics. The topic of 'Can I post someone's art if it looks cool?' was covered as well, and it clearly stated that unless you have explicit permission that is written down from the original artist, then you cannot use their art until you recieve such permission. Although I know that some people on DeviantArt will gladly let others post their art, so long as they recieve credit and a link back to their gallery, it is not the same with every artist. Also, to say that, just because someone posts their artwork on DeviantArt that it is automatically okay to post it elsewhere so long as you link back and credit is wrong. It's still art theft, and this is what really pisses off many Japanese fanartists.

Although it's really flattering for people to want to post your artwork somewhere else so more people can see it, artists who draw well tend to have their pictures stolen from them the most. You know all those pretty fanarts for anime and video games you can find on the internet in galleries? Many of them came from Japanese websites. Many people think that, because most of these Japanese artists don't speak English, that they can't ask for permission to post these artworks elsewhere, and at best will link back to the original website or, if they can, credit the artist somehow.

What these artists, Japanese and all other nationalities alike, find offensive, is that nobody ASKED them. If someone went to my DevArt account and found my Sailor Snake picture so appealing that they decided to post it elsewhere, I'd be flat out PISSED. If you asked me nicely, then I'll be more than happy to let you post my pics, but only if you ASK. That's how it is with most artists out there. It also will help the artist in question keep track of WHERE their artwork is being posted.

What he basically did wrong was, like you said, not getting permission and not crediting and linking back to the original artist. Well, the thing is, none of the fanartists are claiming to have 'created' the particular thing in question. Nobody says they made Final Fantasy VII, or FMA, or whatever when they draw fanart for it. In fact, things such as fanart and fanfiction are usually promoted for anime/video game fandoms because it strengthens the fandom while allowing it to grow and evolve.

These artists, like pu-sama, myself, and many others, will state that we did not create Final Fantasy VII (or whatever fandom we happen to be participating in), and that the creator is [insert name]. The creators, in this case, Square-Enix, are the sole creators and owners of the idea, concept, and execution of the idea (a.k.a. the game itself) known as Final Fantasy VII. However, when a person draws fanart or writes a fanfic, the fanfic/fanart that they drew belongs to THEM, the artist/author in question, not Square-Enix. If I were to draw a picture of Orlando Bloom, he would NOT own the picture, for he did not create it. It would be my picture, so he couldn't sue me for drawing a picture of him because he owns his own being.

Basically, it means this: Square-Enix owns Final Fantasy VII and all it's characters, HOWEVER, they do not own the fanart that I have drawn for it. The fanart that I have drawn is my own creation, and is therefore protected by copyright laws and such. So long as I am not going around claiming to have made Final Fantasy VII and selling it under that statement, then it's legal.

If you did not draw it, then you do not own it, unless the artist says otherwise. Tetsuya Nomura drew the characters for Final Fantasy VII while he worked under a contract for Square-Enix. It was basically his job to draw for the company. I, a fanartist, am not drawing for the company, and thus my drawings are my own. I draw for myself, as do most fanartists, and unless we submit it to a contest or some fanart showcase owned by the company, then they don't own the artwork. They own the concept and ideas that make Final Fantasy VII, but not my drawings.

If I were to write a fanfic for Final Fantasy VII and Square-Enix were to publish it without my permission, they COULD get in trouble, especially if they claimed it to be their fanfic/story. Nevermind the fact reading my stories would be like staring straight at a baboon's a**. If an individual takes the creative works of another and claims it as their own, or uses it in a manner that is disapproved of by the creator (like posting it on various web galleries), then legal action can be taken.

Now, all I gotta do is find this one thing in the FMA fandom where someone explained this matter in a perfectly clear, concise manner. *goes to search*

It doesn't matter if you're doing it for profit or not. You're still taking a copyrighted character design and using it without the copyrighter's permission. I was on my high school's lit/art magazine and that's one of the biggest problems we ran into. Even though our mag was completely non-profit, we still couldn't print the book with submitted fanworks simply because the artist didn't have permission to even draw that character in the first place. It didn't matter if it was a totally original design and it wasn't someone copying something freehand from a drawing. Doesn't matter if you say it's the property of so-and-so or not... Still makes it just as wrong if someone were to plagerize a story, or write a story using someone else's characters even though they might change the events a little. Things are copyrighted for a reason... to keep people from stealing their works or using it in inappropriate ways without the copyrighter's permission. It's something that's a little bit harder to enforce on the net.
