Also! If anyone is interested in this even more indepth here is a book that is the bible for this topic that is put out by the Graphic Artists Guild. 'Graphic Artists Guild Handbook - Pricing & Ethical Guidelines'.
It even has templates for different sorts of legal forms including agreements.
And in responce to the contenuing flow of discussion...
I belive it is fine for an artists to sell prints. If there is an original, physical piece of artwork that was involved with a commission however and they decide to sell it at a later date, I think it is appropriate they offer it for purchase to the person who commissioned it before just selling it off.
Also, obviously they would have no right to change/remake or sell YOUR character. Their rights only extend so-far as the art itself. *nods*
I personally think they also should get permission to enter it in a contest or for display in a magazine or gallery. Most people would probably be smitten about their character/commission getting the spotlight and be ok with it. But it seems polite for them to ask anyway, you know?

Hehe, most of my knowledge comes from the book "Free Culture" by Lawrence Lessig. It focuses less on the whole artist perspective and more on the music industry, but it's real clear about the copyright rules and all, which are extended to art.

WoefulInfinity Hehe, most of my knowledge comes from the book "Free Culture" by Lawrence Lessig. It focuses less on the whole artist perspective and more on the music industry, but it's real clear about the copyright rules and all, which are extended to art. Copyright laws are really simple. There's a nice description and overview of them at www.copyright.gov.

i believe that if an artists asks if they can use an image they did of a commissioner's character in a print it is an act of kindness and not something that should be expected. if the case were that i had to ask permission to use an image i did of someone's oc, i wouldn't draw anyone's characters but my own. though most people don't read it, in my commission terms i list that i can use the image i create as freely as i'd like - which includes using it for monetary profit.
it seems like the buyer would be asking for too much if they needed to be advised of something like that. the artist wouldn't be making money off their character, but what they did with it/the overall image [which i believe, goes beyond the actual character], so i don't see how the buyer would be offended or against someone selling prints/merchandise with their character.

Mm. I don't know - I guess it depends on why people buy the print/other article? If someone buys a print and says "I love the lines/colour/background/way you've done this" I can see that it has no (or little or not complete) bearing on the subject of the image (assuming the subject is a character), but if someone says "I love this character - I'm buying a print", well ... they're buying it for the character and not the overall image (or appear to be).
I really don't have anything against artist's making money from their art (it doesn't offend me, though I probably would find it impolite if I was never told - I feel that I am quite polite when I interact with any person in the universe, so I try to be nice and hope for a return) - it's theirs, how could anyone have anything against that? A deranged robot could, maybe, but not anyone else.
As for why someone would be against selling print/merchandise ... I really don't know, for me it is merely a matter of courtesy (I had no idea I was so vested in manners) and possibly saving myself from hassle in the future (a vague remark, I know).

(I'm pretty new here, so first off, hello to everyone. smile ).
Mmm, I'm not sure I should be giving too much advice on art contests as I havn't held very many but I noticed one thing straight off - it's a little...bland? Maybe just add a little colour to the text here and there (though I don't know, you might be planning that with the banners?). Overall I like it though - plenty of catagorys, nice avatar subjects... 3nodding

That sort of thing is fine! Yes the artist should retain rights to the art they make. I think I said that... ^^` But when doing art of a character that is someone else’s original character it would be wrong to say... make new imagery with that persons character and like... claim it as your own original character and/or sell it to someone else. Or sell the character concept/design itself. That sort of thing. That’s what I meant... ^^` The commissioner who created the character should retain creative rights to the character itself. And you have rights to your art work. I personally would be pleased if artwork someone did for me could help contribute to a steady revenue for them. But it would be cool to know if it was helping like that. Like, I was really happy to know you got acknowledged for that commission you did for me. 8D *struts*

Inspired by nora I went ahead and wrote up a concept on what the catagories and prizes will be in my contest will be that I'll hold at the end of the year.
