The states should be able to decide. Plain and simple. The majority of people in Utah voted against this so why shove it down their throats???
Because it is a human rights issue brought on by a religious institution that illegally donates to political parties. Just because it's supported by the majority does not make it right and preventing gay marriage is no different from preventing interracial marriage.
Did you seriously just compare ethnicity to sexuality?
They really are nothing alike. That's like comparing a child born with no legs to a nudist.
Discrimination is discrimination. How is this any different from refusing to marry people of different races?
Because ethnicity and heritage is nothing like sexuality. I cannot change my blood or my genes. There is so much that comes with one's ethnic background-- hereditary things even--heart disease, obesity etc.
There is no such thing as a gay gene for example.
Homosexuality is VERY different from race/ethnicity in a number of ways.
An interesting but wrong argument. There have been several studies linking biology and homosexuality. For example, the index finger on a make is usually shorter on men unless there is a dip in testosterone. Women usually have the inverse as do gay men. This is developmental in the womb. There are also disorders and diseases that are more common in homosexuals such as schizophrenia in gay men. So there is a hormone link and several toward genetics. One that a person cannot help. The other thing that is worth mentioning is that there isn't even a huge genetic difference between races. The color of one's skin reflects where his/her ancestors were in relation to the equator. People with darker skin needed more protection while people with lighter skin needed to absorb more Vitamin D. The difference between black and white is virtually the difference between blond and brunette in genetics.
So either way, Homosexuality is shown to be biological while race is more aesthetic than genetic. But let's assume you're right. Let's assume that homosexuality was a choice. Then why would that matter? You seem to defend the Mormons on this issue, but religion is a 100% choice. Even if someone is a teenager and is forced to go to church, that doesn't prevent them from being atheists or going Pagan. Yet despite that it's a choice, religion is protected from discrimination as long as they obey the law. So why would homosexuality being a choice be any different?
You can say that homosexuality is biological all you want but I still don't think you can compare it to ethnicity. (Ethnicity is far more than my finger being shorter than another. I cannot hide my ethnicity. Ever. Whereas a gay man can walk into a store and avoid discrimination completely because there is nothing that would indicate his sexuality. I had friends that I didn't know were gay.) You mentioned genetics so are you saying that if a gay woman gets sperm from wherever and has a child, it will be homosexual?
And you mention diseases and mental illnesses found in gays specifically... perhaps that has to do with their sexuality and the anguish of their sexuality rather than genetics.
Assuming that homosexuality is a choice, it would still make sense to let each state decide. This is much like the Uganda thread. Each state has laws that should cater to its people and their situations so if the people voted against gay marriage, having it overturned by a court is a huge slap in the face.
Think about this: Say a state that voted to allow gay marriage got it. Then a few years later some court ruled and approved a ban on it. Slap in the face.
