A little on ban evasion This is a topic where I feel that users sometimes throw around the term without understanding exactly what Gaia means by ban evasion. Apparently journal formatting doesn't actually like a lot of useful BBcode so I'm having to improvise a little with this layout.
The rule which is being applied is covered in the Rules & Guidelines here Please be aware that if your account is banned, you will no longer be able to access your Gaia Gold/Platinum or items that you licensed from the site, or any Gaia Cash that you have purchased.
Or in the Terms of Service here Termination. You agree that Gaia, in its sole discretion and for any or no reason, may terminate any account (or any part thereof) you may have with Gaia or your use of Gaia Online and remove and discard all or any part of your account including its inventory of any virtual items, Gaia Gold/Platinum, Gaia Cash Member profile, or any Member Submission, at any time. All items, Gaia Gold/Platinum, Gaia Cash, and other aspects of your account are considered to be a limited license to you for your use while your account is in open. Due to the limited nature of the license, the inventory in your account, your Member Submissions and any other virtual items (including Gaia Gold/Platinum and Gaia Cash), creations or submissions are considered to be forfeit when you close your account, when the account is banned for violation of the Terms or otherwise terminated as provided herein or in the event that Gaia discontinues the Site. Any fees paid hereunder are non-refundable. Gaia may also in its sole discretion and at any time discontinue providing access to Gaia Online, or any part thereof, with or without notice. You agree that any termination of your access to Gaia Online or any account you may have or portion thereof may be effected without prior notice, and you agree that Gaia shall not be liable to you or any third party for any such termination. As discussed herein, Gaia does not permit copyright infringing activities on Gaia Online, and reserves the right to terminate access to Gaia Online, and remove all content submitted, by any Members who are found to be infringers. Any suspected fraudulent, abusive or illegal activity or any of the other prohibited conduct as set forth herein shall be grounds for immediate termination of your use of Gaia Online and, in certain circumstances, referral to appropriate law enforcement authorities. These remedies are in addition to any other remedies Gaia may have under these Terms, at law or in equity.
This means that if you break rules in a way that leads to a permanent ban, any items or currency belonging to you (the user) may be forfeit.
Here are a few examples of things that could be considered ban evasion
Breaking rules on a mule account to keep a main account 'safe' Moving currency or items to a new account after a warning for a fresh start Suspecting a ban is incoming and giving items to a friend or secondary account so you can access these on a new main account Trying to 'spread out' warnings across multiple different accounts In some situations a violation is serious enough that Gaia will permanently ban all accounts belonging to the user at the time, even without the user specifically attempting to evade the penalties of the ban through the transfer of currency or items. If you are permanently banned and unsure why this has occurred, please PM a moderator who will be able to explain in detail what circumstances lead up to your ban.
However, it is not ban evasion to come back on a new account after a ban as you have not "evaded" the ban. In almost all circumstances, users are very welcome to create a new account on Gaia after a permanent ban and are free to use the site on this account as long as they are abiding by our site rules. While the moderation team does consider the history of a user as whole and not just on a per account basis and prior warnings or bans would be taken into consideration if there were violations on a new account, the act of making a new account is generally not an issue.
Here are some examples of things that are not ban evasion that I have seen referred to as ban evasion
Coming back on a v4 account after the user's v3 account was banned (or any other new account after a permanent ban) Begging for donations on a new account after a ban. If users would like to gift items to users who were banned and have come back on the new account, this is up to the individual and it is not evading a ban to get donations from your friends. If you are a user looking out for the userbase who may report from time to time, please do not report users for ban evasion just for creating new accounts. You are however very welcome to mention in additional information when reporting violations that the user appears to have been previously banned for the same thing on a prior account.
