Okay, so as practicing artists a lot of us have probably had art thieves on our tails.

Well it's never happened to me before now.
So what do you do when you can't do s**t about it?

So I message DA's help desk, and get the following reply:

Now I know this is not too creative and such, but from the copyright point of view, it's okay - poses and similar cannot be copyrighted, characters could be copyrighted, so if she says in the description that this character in it is actually yours and you don't want her to draw your character, that'd be copyright infringement - but from what I can see, she's not doing that.

I agree it might be annoying - I don't recall anyone having redrawn my work, so I can only imagine how it feels, but considering the Policy and the Copyright there isn't too much we can do here.

FAQ #304: Someone has posted an image which looks just like mine, why won't you remove it?

Let me know if you have further questions or if you want me to pass your case further up to the Policy Enforcement Staff for investigation despite all this :aww:

Hey, its too bad DA didnt help but if u want i will leave an angry message on that person's copy..at least you dont need to worry about them trying to sell it as a print^^ no one would buy it, lol

Yah once Weja PMed me and was all like "OH NOS! ART IS STOLEN!" I was so confused, because I was trying to talk to Weja... it's a hard game, it is.

Anywho appearently someone stole mine, and wejas art and said it was theirs... someone compared my art to Wejas! HARHARHAR>

It's not like you can do anything- BESIDES BEING FLATTERED!

You should just be happy someone drew fan art for you! Think of it as "I wish I was as talanted as this artist, and/or creative + awesome". At least this kid realises that you are cooler then poke'mon.

If it makes you feel any better, yours is vastly superior. I've never had anyone trace works of mine, though I have had someone enter a piece of work of mine into a contest and win. Aggravating, let me say. I'm not sure what you can do in this situation other than talk to the offending poster and ask them to credit you.

DA has to be the worst place to host art. Ever. It is painful to navigate, I just use good ol' PhotoBucket. It's simple, easy and FUN!

Are you absolutely serious? Are you really giving this girl a hard time for copying your pose and concept?

"Art Thief" my a**. You don't know what an art thief is if an uncredited homage offends you.

We all love you. Why doesn't that fuel your confidence?

Why can't you set a good example for the rest of us and support her obvious bug for drawing and just tell her that her drawing offended you?

She's not trying to hurt you...she's not trying to gain "profit" or popularity...

Just talk to her and stop calling her a "thief." It's offensive and you can get yourself into trouble.

So no flaming the young ones when they step on our toes.

They just can't dance. Simple as that. Assault charges need not come into play.

I totally agree.
I've seen worse offenders. TRUE offenders, if you ask me: People who blatantly re-upload a pre-existing image, claiming it as their own. That's ART THEFT, by my book.

This? This is just a sort of homage. Comfronting her about it may be the best solution instead of crying thief.

What? and Cerial Experiments obvously didn't read what the artist commented on the pic "she" created.

" Aqua is one of my better drawings. I just love the way I drew her sword and the coloration that I gave her." After saying this I think some credit is due for dear, ol' television. Especially after giving her a name. That seems to me like she is taking a bit too much credit.

Not that what you guys said didn't have a ring of truth. I wouldn't call her a "thief". Just rude. Very rude. Like that small kid who is told by his friends on the streat that it would be cool to yell somthing at you from across the road and run away... this doesn't happen to you?

I never asked anyone to post incendiary replies to her work, nor did I post any of my own. I'm annoyed because:

a) It's quite obviously a copy of my own work, I've never heard anything from this person before in my life, and I wouldn't have minded at all IF she'd asked me for permission or at least credited me in some way. Instead I get a note from her on DA today claiming that she'd never even seen my work before, well excuse me for being skeptical but I find that hard to believe.

b) I find it offensive because I spent a hell of a long time on that drawing, probably upwards of 10 hours. It is a character that is of some significance to me, and to see someone else copying my work and adding or subtracting details here and there to pass it off as their own original character is just tacky.

c) I posted this here in Art Fags because I thought there might be other artists who've been in the same situation and might be able to offer me some advice. As it stands I have yet to make any move against the accused, outside of sending a message to DA's help desk.

d) Okay, so we disagree on what 'art thievery' consists of. Nonetheless, neither the accused nor myself see this as any type of "homage" since she insists utterly on her innocence.

This shouldn't be seen as a case of "my art is good, their art is bad and so they should be allowed to get away with it." If my art was shite, I'd still be upset.

a) That it is, I cannot deny that. Also I can't avoid playing a bit of the devil's advocate sometime, but in this case it seems clearer and clearer that something must be done.

b) I know, I commented on the WIP thread in which you originally posted it some time ago. It's a really good piece because I remember it.

c) My advice, then, is: Do something. Confront her. Show her proof. Analyze, turn her "artwork" inside out, showing the REMARKABLE number of similarities between both, and how you made yours first quite some time ago.

d) Good. I agree with you, 100%
