how can i tell a Legitimate pkmn from a hacked one?

It depends on how careful the hacker was.
Check the following:
1. Where it was caught.
2. What level it was caught at.
3. Movesets.
4. IVs.
5. Abilities.
If the Pokémon doesn't appear the route it was caught, wasn't caught in the appropriate level range, has moves it can't learn, IVs that are clearly unrealistic (all 31s, anyone?), or has an Ability it can't have, those are easy signs that it's hacked. Master ball catches are also a pretty good sign that your Pokémon may not be legit.
Careful hackers that HIDE all this behind the guise of legit Pokémon make some specimens impossible to verify. The chances of running into a careful hacker are low, though.

1. Where it was caught (or if it was bred).
2. What kind of Pokeball is it in?
3. What level it was caught/obtained at.
4. Movesets.
5. IVs.
6. Abilities.
And in terms of possible Event Pokemon:
7. Ribbons (if appliable).
8. OT name.
9. OT ID number.
Pretty much, you need to evaluate anything and everything on the Pokemon to get justification that it is legit. Even then as Kurai pointed out, that is no safe guarantee that it's legit, as some people try to conceal the fact that thier Pokemon are illegit. Of course, it's rare to get those sort of Pokemon in trades.
One other thing you could check is, you could try uploading it onto Pokemon Battle Revolution to make sure the EVs aren't at an unobtainable number (510+), that of which will also causes the Pokemon to show up as a "bad egg" on the Wii and won't do any harm to your game as the DS "bad eggs" do.

OH crap so i wont be aloud to use my weavile cause it has 31 in all stats exept atk which is 21? D: that not fair mine is legit!

Well now i have to work on an Electivire of my own since the one i have was caught at around lvl 56 or so in a master ball gonk anyone have an Electerizer? >.<
