Depends on how you look at it, really. Mew can be concidered the best because it can learn anything. Mewtwo and Darkrai have great speed and great SpAtk, as well as an arcenal of moves to utilize it. Arceus has the highest stat count in the game and can be any type. Dialga's typing and defences make it hard to take down when trained properly. Same goes for Giratina. Palkia is like Mewtwo but with less speed and SpAtk, and more defences and different typing.
Then you have the non-uber legendaries that vary from pokemon to pokemon and in some cases are more useful than ubers. I guess it all boils down to personal prefference.

Mewtwo/Darkrai/Giratina-A. That's my personal preference. And another fact to add to the list Luther gave is that Kyogre wields the most powerful Special move in the Game. (Water Spout + Full HP + Choice Specs + Drizzle + STAB = Excessive Overkill)

I loathe the use of Legends. It feels cheap; I'd much rather use UUs and NUs to get the job done, rather than use Legendary Pokémon as crutches. ._.

- Raikou is my favorite right after.
sadly, I agree with kurai. Personally I just find it wrong for a person to go after the legendaries right after the professor tells you not to.
and the fact i find there are way too many now.

Well, it depends on your criteria for the "best" legendary! If your going for overall stats, I do think Kyogre would win out, because of its massive sp.atk and when used with correct strategy, its a nearly unstoppable sweeper! For pretty much any other criteria, its just personal preference! Like, my personal favorite legendary is Celebi! Its just an awesome pokemon in general! Doesnt at all mean its the best stat wise or anything, but to me, it is the best!

My favorites would have to Darkrai and Giratina-O. Darkrai first off because:
1-He's a humanoid pokemon with the power to float/fly (See movie)
2-He's the Krueger of Pokemon.
3-He's a Dark type. Personal favorite.
4-He just looks cool. He can pull off the smoke hair.
And for Giratina-O
1-A Phantom Dragon who can appear and disappear at will. Epic.
2-It has multiple forms, but I like Origin form best. I also imagine it having and humanlike Warrior Form, which I may try to draw or somehow create a picture of in the future.
3-It lives in (and is the ruler of) the Distortion World, where all common knowledge is twisted and defied. It also acts as a way to keep balance within the World of Pokemon.
4-His Platinum battle music is EPIC!
As for non-ubers, I have to say...Zapdos. That bugger has helped me out numerous times, and has been an integral part of my Yellow/FR/LG teams (usually as a flyer with punch). And he shall be a part of my mono-type Electric team, giving Theonix more importance.
