I heard that he was part of TNA, but quit because he owns his own bar now or something (which makes sense if it's true because of his nature, i mean Stone Cold stole his gimmick)

well...I'm not quite sure. I dont think he's quit because he wrestled with dreamer and raven at A Cruel Twist of Fate in the UK like a month back.

TNA will probably bring him in sooner or later, if only to give Sabu someone else to fight than Abyss. They had him in 2003, but didn't keep him, for whatever reason.
Oh yeah, it seems like TNA is getting all the former ECW guys on their roster now. Maybe Benoit's next?...

Benoit seems very satisfied with staying in the WWE for right now. I don't think he'll be leaving anytime soon. Especially with Eddie dying, i think he'll stay there for awhile to carry on with a higher level of competition. Besides, he's a title contender right now, and they could conceivably push him for the Heavyweight title again soon. Vince recognizes the talent, and would work very hard to keep Benoit from leaving.

Austin's was a redneck from Texas that would do anything to defy authority. In short the Sandman's gimmick was (as Paul Heyman put it) "A tough guy looking for a fight" who specialized in the use of Singapore Canes. Now if beer-drinking is stealing another's gimmick then tell that to the A.P.A. and Terry Funk after he won the ECW World Heavyweight Championship.
