The game doesn't have issues with publishing, Microsoft owns the rights to publish it and they want a sequel because the first sold a million and a half copies. The game's not coming out because it doesn't have a Developer. Real Time Studios has said that Microsoft waited too long to ask them for a sequel by which time they started focusing on other things. They've said they'll work on it if they have resources after APB comes out, but beyond that all that remains is rumors of a studio that was created by some Real Time employees making the sequel.
