I'm not enitrely sure, but I think it's when he's on the pole. They say there's a shadow behind him of the man.

Actually, I just looked it up on youtube, and it was when Dorothy, Scarecrow, and Tin Man were talking, then they skipped along and sang "We're off to see the wizard". Not sure when exactly that occured in the movie, but...
There's rumors about it being a hanging man, but others think it's a bird... Hmm..

I think they would notice a hanging man in the forest, so it's probably something more obscure like a bird or shadow. Plus if they did notice it, they'd probably fix the scene, eh?

Well, see, they say the background was recorded before they did the actual scene. If it was a person, it wasn't meant to be there, and would be an accidental "caught on film" thing. If it was a bird? Well, it'd be a pretty big-a** bird XDD
