Rogue's touch is no longer lethal; it simply steals the memories and abilities of individuals she comes in direct skin-to-skin contact with. Rogue usually only retains a mutant's powers in direct comparison to how long she kept hold of that mutant. It has nothing to do with their mind in her own ratio. It was "implied" that Rogue only held Mystique by the face for a few seconds. Not long enough to keep her morphing abilities for more than minutes at most.
