From what I understand, Ness learns the following in Earthbound:
Lifeup (α, β, γ, and Ω)
Hypnosis (α and Ω)
PSI Rockin' (α, β, γ, and Ω)
Healing (α, β, γ, and Ω)
Shield (α, β, and γ)
Paralysis (α and Ω)
PSI Flash (α, β, γ, and Ω)
Teleport (α and β)
It's Paula and Poo who learned PSI Fire, Freeze, Thunder, and Magnet.
And it makes no difference whether it was canceled or delayed (though you are right, it was canceled in 2000 and transfered to the GBA three years later). According to the the Japanese Smash Bros Melee site, on Ness Profile to be more specific, Lucas was intended to be in Smash Bros Melee in place of Ness but was pulled out due to that fiasco. It is likely that that is what occurred here.
Confidentiality wavers are used for the sole purpose of keeping information from leaking to the general public before the time that the company desires the news to be broken. If you ignore that waver, you are going to be sued, especially if you are dealing with a company as big as Nintendo. And I think that that the benefit of keeping the rest of the information from leaking would outweigh the cost of confirming two or three rumors.
Wrong. He never learns Teleport β, and I'm pretty sure he gets PSI Magnet, but I'm not as sure of that one.
I need to beat EB again after I beat MOTHER 3...
I know, dude. I am the Cult's resident EB fanboy, and I brought this same issue up months before Lucas was even confirmed.
There's a difference between Melee and Brawl. Melee got MUCH more publicity and sales than Smash 64.
And Ness wasn't a two game veteran, as much a WTF character in SSB, as many had never heard of him before.
Now he has a fanbase, and he's become sort of a staple of the Smash series.
Uh-huh. I believe he is lying as well. I'm just saying that since he has no proof, no way to validate his claims, they will fall on deaf ears anyway.
So it's really a non-issue to the dev team anyway.

What he said, and Ness does not get PSI Magnet. I've looked it up (I couldn't have remembered the full move list had I not).
But I'm not going to argue about this anymore. I've got a terrible habit of playing Devil's Advocate. I don't have a preference either way on Ness' presence in Brawl. If he's in, so be it. If not, whatever. Either way, I'm going to love the game and I'll be playing with every character available just like I do in Melee.

I was pretty sure that was Poo's exclusive technique aside from Starstorm, but I'll go with that for now.
Oh don't worry. I'll still love the game, and I'll still play it next to every day.
I just believe Ness will return. If I am wrong, then I am wrong.

If Ness isn't playable he should be a Assist Trophy that appears and uses PSI Rockin' Omega on the entire screen

Nah. Ness as an alternate would be nice, but their moves look to be too different so far.
One reason I think Ness will return, but that's a debate for another day.
But I would LOVE alternate costumes. NINTEN4BRAWL! xd
Joking, but it would be funny as hell.

At the moment, there is no way to get MOTHER 3 or EarthBound Zero without using ROMs.
So really the only one you can get legally is EarthBound, and the cart can go for about $100
