I can't speak as of DC, but I know that Marvel's cracking down on these cuz they're starting up their own 'legit' torrenting service. It makes sense to stop the illegal competition before launching their own service.
DC still hasn't quite savvied up to the fact that the digital age is upon us, this was pretty evident at the Chicago Con panel.

The announcement I saw from Marvel was that they're going digital with old comics and not the new releases. And really there is all not that much difference between selling comics 2nd hand and torrenting them online.

I dunno....the story I read said its back issues....specifically mentioning the first 100 issues of X-Men, Spider-Man, and Fantastic Four. They also say it will be initially 2500 issues available.

Here is the story.BBC New issues, however, will not go online until at least six months after they first appear in print. Customers will not be able to download the comics either, which can only be viewed in a web browser window. I don't think Marvel quite gets it all the way......

Interesting business model, considering they've already made the entire Spider-Man and FF runs available as .pdfs on disk.
This 'view comics online' thing in the style they're descirbing failed miserably for CrossGen...
