Kitty reacted... and quickly. While he lunged forward, she brought her upper body back and wrapped her hands around his arm. She used his momentum to throw him over one hip and onto the ground. From there she pressed the toe end of her heel right into his neck all in a matter of seconds! Why she hadn't just made herself intagiable was a mystery.
He might be able to see up her skirt, but she felt at this point he was more concerned with breathing. "Listen, I am just a hair away from crushing your windpipe.. you have a few seconds to explain yourself before you leave this place in a body bag. What do you have to gain by attacking me?" She may have her foot on his throat, but she left enough breathing room for him to respond.

Suddenly he was flipped over from Kitty's karate move and her foot was squeezing the air away from his neck. Using both hands to try and resist her foot on his neck, he wasn't strong enough to lift her foot off. Without his powers he was almost just an incredible weakling. He started to mutter out, "You... Got it... All wrong..." The pressure against his neck started to become heavier as he changed his tone, "You know... I've never hit a girl before... But you're really starting... To push it..." Suddenly, the faint sound of music started to play in the air...

Kitty removed her foot from his neck and lifted him up from the ground. Had it not been so easy to throw him, she might really have done some damage (at least until his own powers manifested). "Then what were you doing? You lunged at me just now!" She took a few steps back. If he were to retaliate now, she'd have enough room to react like before.

Standing there regaining his composure and breath, he tilted his head down while the music played. "I told you! I didn't attack you!" he said more aggressivly and almost unbelievably considering his tone. He couldn't help his tone however due to the song that was playing, which granted him unstable abilities to use destructive magic. Of course it only granted him that ability and no super strength or vitality so he was more or less dependant on the magic. The transformation didn't change any physical appearances however it did infact change his attitude. "Just go run along to your little mansion before someone gets hurt..." he threatened with his arms hanging down to his sides and head tilted down...

"You.. know where I live?" This encounter had crossed the line into an even stranger territory. She noticed his change and demenour and tone, and fixed her stance into a much more defensive pose. "What would you call what you just did? With that growl or whatever.. and you jumping at me! How else would you expect me to react.. just let you... hit me? No!" She had decided to ignore his threat. If he chose to under estimate her because of her outward appearance, then he was in for a unpleasant surprise. "You can't blame me for what just happened. That look you were giving me walking up, and then the lunge? It's not like you waved and smiled!"

The transformation was full now and during this song. He was not only reckless in what he was saying, but his abilities granted were reckless as well. "Who wouldn't know where you lived if they hadn't have several run ins with the X-men already, Kitty... I know the authorities sent you to come find me as well... I gave you a chance to leave..." he said calmy, but building up as he went further in his speech. Finally he ended with his head shooting up so that his glowing red eyes were eye level with Kitty's saying, "Now, you must be dealt with!" His right arm stuck out at a 90 degree angle from his body and from the palm of his hand he fired two strings of electrical bolts towards Kitty Pryde...

And he knew her name? Freaky! "Eep!" She shot sideways and through a wall nearest to them. What sort of powers did this kid have? Why hadn't he used them before when she threw him on the ground. Regardless, if he wanted to fight she certainly wouldn't back down. She phased into the ground this time and popped up behind him, throwing her fist outward and hoping to connect with the side of his head.

The two girls dove into a nearby alley and peered out around the corner to watch the fight. "Guess we'll have to wait untill they're done." on said to the other with a smile.

Upon missing, his eyes changed from the glowing red to normal eye vision. The girl was falling through certain areas like a ghost and without realizing that she popped up behind him, he turns his head to late and realized the hard way that she was behind him. She had thrown a punch which connected against his cheek and sent him staggering the opposite direction till he fell onto the ground landing on his rear.
Citizens in the street were noticing the fight between a magic using man and a young girl who could walk through walls. Recovering from the hit, his vision was temporarily blurry for a couple of seconds but came back to normal. He rubbed his light red cheek and started to grind his teeth and he picked himself up. "So you think you're a tough girl huh?" he said to himself as his lowered both his arms down to his side to where his hands were even with his hip. Both his arms started to have electricity spiral and coil around it as he prepared his attack. With one arm he shot out an electric energy blast up above Kitty to hit the building wall above her. It caused a small explosion and with it, the bricks came falling down towards Kitty...

"You stared all of this!" Kitty shouted defensively. She crossed her hands in an 'X' fashion as the electricity shot out at her. Of course, it passed right through her, but the course was altered and instead of going straight, it shot off toward the building and shattered the nearest window. The two of them now showered in glass which of course fell right through her as well.
She looked horrified and launched herself at him again, becoming tangiable just in time to knock him out of the way. Unfortunately, a falling brick connected with her shoulder some time during the scuffle.

ENTER from DC Universe  [Court is now in session...] A voice said in his head as he walked down the streets of New York to finally meet his, 'target'. He had a slow pace as he noticed the scuffle up ahead involving Tempo and a girl. He had both his hands in his pockets as he had his head tilted down. The girl had nothing to do with this so it was unecessary to involve her, but if she got in the way, she may have had to be dealt with. [In the case of Michael Brock, charged with four counts of armed robbery...] continued the voice in his head. He stopped and stood there along with a couple of other citizens who were once watching the fight between the girl and boy, but now staring at the mans horribly disfigured side of his face. [...six counts of aggrevated assault...] said the voices as he reached in the inside of his suit to pull out a silver gun. The guns pressence scared off the citizens as they began screaming. [...and two counts of public endangerment...] said the voices as he then reached in his outside pocket with his other hand. [Has the Jury reached a verdict?] finished the voices as he pulled out a two headed coin from his pocket, one side marked with an 'X'. He aimed the gun towards Tempo and pulled the hammer back. With his other hand he flipped the coin... It lands in the palm of his hand... He looks down and pauses for a minute... The gun fires twice and the cold winds start to pick up from the silence that followed soon there after... He mutters to himself in his low, raspy tone of voice, "Guilty..."

Tempo saw the girl being hit by the magic, but it went right through her as if she was a ghost or something. She must have had the power to become tangible and untangible. In any case her reaction was so quick that she had enough time to push him out of the way of the falling glass shards and bricks. A couple bricks hit her in the shoulder and she was down on one knee nursing her injury. This could have been the opportunity to strike at this advantage, but Tempo started to snap out of his aggression as the song slowly came to an end. His powers were fading and he started to snap back into reality. "What have I do-n..."
His eyes widen as he gasped for one last breath of air. He couldn't finish his sentence as he stood there for a second, paralyzed. He had been shot twice in the chest and he slowly reaches for the wound with his right hand. He dabbs his fingers on the wound to confirm the blood, but the bleeding didn't stop there. Blood was starting to trickle from the sides of his mouth as he hit the ground knees first, then fell face forward onto the ground. He laid there looking up from the ground to see citizens in panic as his asailant(ms?) stood about 30 feet away from them, clearly still pointing the gun towards him. "Harvey..." he whispers to himself, drawing his final breath... Perhaps, he had this coming to him he thought. Even if Tempo was a good samaratan(ms?) every once in a while, it didn't outweigh all the pain he had caused to others because of his lust for personal gain. Was it Karma? Did he truely deserve this? In any case, he knew that he had paid the ultimate price from using his powers in the manner that he did. He was incredibly apologetic to everyone in his thoughts due to the fact that he couldn't mutter those words out in his condition. Those were his final thoughts before he shut his eyes, and stopped breathing...

((omigosh, that's so messed up! lol))
Kitty sat in horrified silence, phased at the sound of the gunshot staring at the now dying (or dead) Tempo. She breathed in short bursts as she looked from his body to Harvey whom held the gun. She stood up, her fists clenched tightly at her sides while she kept direct eye contact with Tempo's murderer. "What have you done?!" She shouted, tears escaping her eyes when she stopped just short of the boy on the ground. "Someone call the paramedics! He's... he's dying!"

The two girls stared in horror as the boy fell to the ground and didn't move. After a few minutes one of them finally found her voice, though it was barely audible. "W-what happened? I-Is he..." she began. The twin suddenly rushed out towards him, and the other girl tried to grab her. She watched her run up to the boy and girl and kneel beside him. She turned her attention back to the crowd and found someone with a gun staring at the small group. She backed up into the alley a bit farther. She'd stay hidden while her other checked on the boy.

(( Lol yeah I know! However, you just gave me an idea... Thanks to you, I don't think I'm gonna kill Tempo off yet! Although, that choice is kinda up to you now lol. )) Placing his gun back inside his suit in a holster, he stared at the small group of people near the fallen boy. His blank stare was incredibly cold as he put his coin back in his pocket and started to walk away. He wasn't going to answer to the two girls and his job was done. Once he turned around to walk away, he gestured his hand to signal to the rest of his gang to move out. EXIT to Gotham City
