You could always try loading an earlier save (not hours ago just a bit earlier) and coming at him again. I never do the Stormcloaks, however the Imperial side has the same quest (nearly) and I have not had any issues myself. Going back to an older save may clear the issue.

. . . only abandoned. Personally I recommend against that, I have played many Beth games and it sucks when a file becomes corrupt.
