Indeed it does! The Eastern Blue Bird, your Honor, was -sorry- IS native to the northeastern states of this country. In fact, it is the state bird of New York. New York, of course, is a well known hotbed of superhero community in my client's time. Even Mister Murdock's office is located in that state.
HOWEVER...during the entirety of the year of 2007, MY CLIENT WAS NOT!

Your Honor, I have here proof that, during 2007, my client's residency was in Los Angeles, along with the rest of his superhero team, the Loners. These are receipts of the many purchases my client made at his local corner store. As you can see, he purchased many, many maroon-hued cows there.
BUT, you say...that is not enough to discredit this tape? Go on with your analysis, Mister Dox.

Further analysis of the tape reveals a digital clock in the background, setting the time at 4 p.m. The angle of light from the window indicates a western exposure. The angle of light as projected on the floor is consistant with the location of the sun at that time ONLY if the clock is in an Eastern time zone.

Very well. Now, I suppose it COULD be argued that, somehow, my client left California, traveled to New York, put on a tutu and did this dance that my expert here assures me was called "the Electric Slide" on the fateful day this video was made...
...Except that he DIDN'T.
Because, you see, your Honor, four o'clock PM in New York is one o'clock PM in California...and I have SWORN AFFIDAVITS from members of my client's daily support group "Excelsior" that indicate he did not miss a single one of their meetings during the Spring of 2007.
A support group...that met from noon to two p.m. every single day during the time period in question.
Your Honor. It is not in the realm of this trial to say HOW, or WHY this tape was made. It does not matter WHO is really on it. All that matters is that it is NOT my client.

Your Honor, if this tape is not my client, and there is NO signed waiver from my client that indicates he wanted to debase himself in fashions consistent with this television show, "Road Rules" that is mentioned on the tape, then the Plaintiff respectfully demands this piece of evidence be stricken from the court record! The lack of true evidence that my client, in some insane twisted logic, AGREED to have his likeness debauched puts Mister Murdock and his entire crew in violation of Section 50 of the Civil Rights Law of the State of New York. The state in which the 3 Devils Production videos were published and distributed! Section 50 of the law states, and I quote: Quote: “A person, firm or corporation that uses for advertising purposes, or for the purposes of trade, the name, portrait or picture of any living person without having first obtained the written consent of such person, or if a minor of his or her parent or guardian, is guilty of a misdemeanor.” The Plaintiff has CLEARLY had his Civil Rights infringed upon, and no amount of handwaving by the defense is going to change that fact. Mister Dox, you may leave the stand. Thank you for your time.
