-The shark was planning this.
You see the shark had been at such an angle that when it had grabbed Evil it would bleed onto it's Death Note hidden in it's gills and spell Evil's full name. It also mentions that the shark immediately regenerates his legs and thus regenerates his legs.
The shark then says-
I am Kira.
