a mod cursed in QandA eek Twistex As for the contract being enforcable or declared void (since signing the TOS and rules agreement upon joining does act as a contract..) I can't think of many (if any ways) in which this contract could be rendered null or void. If the contract was signed under duress, then it can be rendered moot, however, if you've been signed onto a website at gunpoint, and then proceeded to hack/scam/exploit.. There's larger issues at stake then a banning of an account you wouldn't have signed for anyways. Like.. Who the ******** holds a gun to somone for gaia? As for the contract being rendered invalid due to somone with improper mental facilities to understand/comprehend and therefore adhere to gaia terms and regulations, that's why we include a clause requiring those under the age of 13 parental consent before joining. There's been threats of lawsuits over accounts before. I've read a few of them in ED, SF, and Q&A. The issue is, Gaia TOS is setup with pretty sturdy legal boilerplate, and being a privately owned, free site, there's not a lot of angles for attack. There isn't a lot of questionable legality over the banning of accounts for purchasing items made available offsite. It falls under the article X of the TOS, involving reproduction or resale of gaia items or property for profit. Since no one is allowed or entitled to resell Gaia items, purchasing them would also violate the same clause. Under standard US law, even if you are unaware of the illegal nature of the items you purchased, those items can and will be removed from your person, and your access to those items blocked.

eek eek eek eek eek wasabi posted in that thread we have similer intrests when it comes to SF and Q&A i think xd Wasabi Goddess COBI_321 Wasabi Goddess Elrin_02 Wasabi Goddess A lawsuit for damages? Have you read the TOS, sir? Any damages would be property loss due to a banning. I'm not saying the case would win, just that a case could be made, potentially. That's not saying much. You can make a case for pretty much anything these days. Although it would be a frivolous case. Like people suing McDonald's because they got fat. rolleyes dude, they settled that case. McD's dropped the super size and now did you notice everything has the grams of fat on it? There were several cases similair to that one. That was just a vague example. I was just giving an example of how you can make a case about pretty much anything, no matter how stupid it is.

Oh the logic is so bad it hurts my eyes, but eh.
Buying and selling of items and moneys within online games is illegal, it is cheating, it is a sign of capitalist greed, and if you do it you should get sodomised in an unpleasent way (only if you don't want to be though)
I think we probably should give the mods the benefit of the doubt in most of these cases, but I am only saying that because I don't know anyone who got banned that I believed incapable of cheating (and the ones that did, I was pretty sure they were)
They may be incompetent when it comes to stopping people botting, but they still care about gaia in a juvinile 'lets hold hands, but nothing below the waist' kind of way.
And MaCCa D's
McD's is fattening, but they pretended they were real food, this was grounds for legal rape.
Stupid is not a crime in the US of A, but lying about your product when people supposedly regard it common knowlege that it is bad for you is.
Of course, just look for the most expensive lawyers, I personally like my chances better in a trial by combat...
