Slippery slope...

But it does open up some scary doors. The ruling works under the premise that once consent has been granted and the "sexual act" started consent can not be withdrawn. This is a horribly wrong ruling, but it the new and even worse problems come in as follows:

What counts as consent? If she is drunk, half awake, and incoherently mumbles something is that consent?

What counts as the actual begining of the sexual act? Is it kissing? First base, second base, third base? Is it the dinner you buy her at the date? When does "sex" really start?

It becomes possible to say a woman who was drunk and gave a man a kiss goodnight, who had previously (when sober) said "no" to sex, is not raped because while being drunk and consenting to kiss him she was consenting to the begining of sex and therefore the intercourse that follows the permitted kiss is not rape.

As if rape victims didn't have it hard enough already to prove they did not consent... this is bull s**t.

I heard about this a while ago (Thanks, feministing and feministe!) and it's very, very troubling. If you clearly tell somebody to stop, and they don't, it's rape.

Consent to sexual activity isn't all black and white, all-or-nothing. That's why open communication is so important. One person can assume that a "yes" to french kissing is also a "yes" to touching of the genitals, while the other finds this objectionable. Those bounderies have to be defined, and both partners should be able to say no when a boundary has been crossed, and respect each other's boundaries. But since (especially in the heat of passion) boundaries are hard to determine and people can (and most certainly do!) change their mind and redefine them, you HAVE to listen when somebody tells you to stop.

I've had to say "no, stop" before in the middle of sex because it was really irritating my flesh and was too painful for me to continue. Fortunately my boyfriend is a really caring and loving guy and complied with my request.

But seriously, that's pretty sick.

There've been times when I've said to my boyfriend "Can we stop? I'm too sore." If he'd kept going I would have reported him for rape and dumped him. I hope, anyway. :/ But that'd be legal in Maryland? Oh Emm Gee. That's disgusting.

Bullshit. If the woman says to stop and the male keeps going, it becomes unwanted sexual intercourse - rape by definition! Likewise if the woman is on top, the man says stop and the woman keeps going, it's rape by definition.

That appals me to no end. mad I showed it to my mother who despises rape with every fibre of her being and thinks rapists should be punished with castration. "YOUR NEVER GOING ANYWHERE NEAR MARYLAND!" is what she said to me. o.o My mom is scary sometimes.

But seriously that makes me sick. As a person who has had to say "stop" I feel violated just reading that.

Aside fromt his Maryland has great laws concerning women's rights.

Maryland is one of the few states that, if Roe V Wade was overturned, women would have no change in the abortion availability or rights. Women would still be permitted to abort. I also believe we have a thing that only one parent, not both, needs to consent for the child's abortion, and that there are exceptions made by doctors' concern, not judges'.

I hope this case gets appealed, and the ruling overturned.

Oh no, that is not the only concern one might have,

Should this spread, inspired, in other states, it can and may BE applied to abortion as well. It can be extended to include pregnancy, should such conservative blind idiots be allowed to influence our laws.
