A three-judge panel of the Court of Special Appeals Monday threw out a rape conviction saying that a trial judge in Montgomery County erred when he refused to answer the jury's question on that very point. The appeals court said that when the jury asked the trial judge if a woman could withdraw her consent after the start of sex, the jury should have been told she could not. The ruling said the law is not ambiguous and is a tenet of common-law. The decision startled activists who believe people have the right to say no at any time. Jennifer Pollitt Hill of the Maryland Coalition Against Sexual Assault called the law "insulting and dangerous." Montgomery Delegate Jean Cryor said the Women's Caucus of the General Assembly would likely examine the decision during the next legislative session.

That's just... wrong. I know when I'm having consensual sex with my fiance, I will sometimes change my mind in the middle, and he'll stop immediatly, no questions asked. If he kept going it WOULD be a violation, because, well, my emotions and I aren't in good communication. Sometimes I don't realize until after we've started how I really feel. Any woman with that same kind of problem is in trouble in Maryland now. No always means no. Period.

I completely disagree with the law, and agree with the opinions stated before mine. No DOES mean no, whenever it is said should not matter. If you originally said yes and intercourse begins, and then you change your mind and say no, your partner should stop and if they continue it is a definate violation of your body.

I agree with the others, even though it's been started and she changed her mind he should have stopped. I'm 16, and I am still a virgen. Me and an exboyfriend almost had sex, I told him I wanted to. I changed my mind when we it almost started, he came closer to me, and told him to stop. He just kept saying that it would be okay, and it would be "fun." He kept trying and I kept squirming out from under him. I finally pushed him off, and told him to stop being an a*****e.
The case presented was a little different because it started, but either way you should be able to change your mind at anytime.

And this wouldn't be rape?

Yeah, seriously, you say yes, and he starts all gentle, and then starts getting way too rough, maybe going for other holes and hurting a woman, and you aren't legally allowed to change your mind? Bullshit.

i think they just say that because it would be hard to proove if you said no in teh middle -.- which is stupid -.- so you basically need to have sex until hes done and ready to stop? sounds kinda sexist to me

Thats absolutely horrible! I know with my current bf if he ever hurts me or if i ever get nervous or ANYTHING. He well stop or not push me. which i love because my first time wasnt...exactly consentual. No is no, and as others ahve said im sure they only threw it out because it would be hard to prove and what not, she said it was ok then it wasnt...kind of thing...which the guy might be thinking she was just purposely trying to screw him over. Some people are just idiots though. And the law is often blind.

Ladies, I understand where you're coming from. No definitely and at all times means no, but it would still suck. I know it would piss me off really bad if two minutes into sex I was told to pull out and go away. I think that would apply for any guy. If you started enforcing that as law a lot of guys will get ******** over. It would just make it easier for girls to yell rape on a their bad move and put decent guys away for five years.

I think you're getting confused between saying no DURING sex and saying no AFTER sex. If you consent to sex and later regret it, that's your fault. I think most of us agree that it was still a decision within your power. However, if you start having sex with someone and decide a little or even a long way in that you just can't do it anymore, or you don't want to do it anymore, continued penetration is a violation of your body and your right to your body. So no matter how much it would suck for the guy to not get his satisfaction, it would suck more for the girl, because her body is being violated. P.S. I'm not entirely sure where you live, but here in the UK, rape only has a 5% conviction rate. So no, NOT a lot of guys will get ******** over.

I have to say i get rough sometimes, and with a fiance with the past abuse as mine, you have to be ready to stop at any time. when emotions come in to play negatively, you have to fix it. I know I've gone countless times with having to masturbate bc she stopped in the middle of it and i had to hold and comfort her. that law needs to be amended
