The infirmary may be late tomorrow, as I've got an early day at the courthouse. Christianne, my daughter (ciry1 cool has to testify in the trial of the drunk driver that caused that accident a few months back. Apparently, it's not in him to just ball up and take it like a man. The only thing I can think of is he's trying to say since he didn't run over the guy (Chris did), then he's not at fault, even though, had he not been drinking and driving, he wouldn't have been blocking 2/3 lanes of the freeway and caused the accident to begin with. *sigh* It's gonna be really difficult for me to NOT go to jail for contempt of court tomorrow! Wish us luck.
Will be thinking about you both! heart

We walked in to the Victim Witness room and she was shaking, and bright red. She signed in, and we sat down......for 3 hours. Finally, the Assist DA came to talk to them (3 others involved), and said there's no room in the courthouse, and he's getting permission to send everyone home, since there will be no testifying, but the only way he can do that and NOT subpeona them again, is to go over their statement again with the investigating officer (who just came back from vacation last night, and had NO idea about today, at all, until he showed up to work last night). While Chris was back talking to Office Bailey, Carol (Chris's gramma) and I were talking a little about what we knew about it. The girl next to her was actually the only witness to the whole thing, and she filled in the gaps. What REALLY happened...
Dude was flying down the freeway, swerving, so she got out of his way. As he passed her, he swerved a little too far to the right, over-corrected, and ended up hitting the median, where he began to spin out. Motorcycle was RIGHT there, so the spin-out involved the bike. Mr Fugate flew off his bike, where the next 3 vehicles proceeded over him. THEN Chris came along, and ran over the bike bits. It was a mess, and ugly, but he was in one piece, only had injuries on one side of his body, and Chris didn't add to any of it. Hearing that, you could actually SEE her feel better and let the weight she's been carrying with her go. It was a physical thing. You had to be there, but from here on out, she'll be ok with this whole thing.
Now, since it was a preliminary hearing, they allow hearsay, so the officer can testify on everyone's behalf, so they won't have to come testify at all, unless it actually makes it to jury. That'll be the only way she'll have to actually testify in front of a jury, in which case, I think I'll sit in the courtroom every day. I won't make up my mind on that until it actually happens.
Getting the updates from here on up.
