He just posted this today and not long ago, I haven't seen any replies from anyone associated with Gaia quite yet.
This definitely isn't the first time the rise for concern to this sort of situation has arisen.

Honestly I don't believe it should cause for concern because without all the poses being used together it's not very recognizable and fairly simple, design wise.

I don't have much else to say I want this to be a discussion for everyone here what they think about this situation as well as what they think will happen!

It's going to turn the way of Homestuck fiasco (hate from both sides), rather than quiet route of Hatoful - even though Hatoful game is free at first and now buy-able with cash on Steam/PS-platform (creator of Hatoful is A-OK with the item reference). Worse comes to worse, you get Queen Of Dorks version who got herself a nice drama encyclopedia page somewhere online (with the item description tweaked).

yeah he really doesn't get how it works here, he probably doesn't understand that outside of the promo image each pose doesn't really "rip off" his series and more plays tribute to it in a positive way.

hopefully someone talks to him and lets him know this is just a misunderstanding of intentions

Following what other people said in Site Feedback (another thread concerning this), the creator is intending to get people from multiple websites to hate on Gaia. So yeah, we're definitely going to see another Homestuck fiasco in the making. If someone wish things were taken quietly and professionally, don't expect it happening on social media websites, especially from the west (well, USA in general). rofl

Hit the nail on the head! Money causes all kinds of problems tbh. Fandom items on here are of course monetized but at the same time, it's not like they're just ripping stuff off and claiming it as their own.

I wonder how they feel about people who sell fanart and doujin of their works? Maybe they overlook it because a person isn't a company no matter how small. I wonder how they feel about major outlets like World of Warcraft parodying their work? (not that they have but it's always a possibility and there's money there too)

Reference items are made out of love/admiration/appreciation, from both the artists and the community...but so do fanarts and the like, and there are creators that do not like them, heck, some don't even appreciate their fandom, even the good parts. I'm not worried about Gaia getting in trouble for it, but I'm saddened about it, since the artist that made the item most probably likes the game sweatdrop
I don't see a problem with artists selling their fanarts and djs, much less Gaia selling reference items, since it's up to gaians to use all the poses or not, and in the latter case you usually don't realise that pose references something, this item in question isn't even straight up the same, unlike fanarts where you can clearly tell what character it is emotion_skull

Oh look it's the homestuck-item fight again. No matter how you try to explain it to Dan or even if he understands, now that he tweeted that his fans are now going to attack on Gaia. May it be on the forums, artists or admins, they are going to get so much hate mail. This is why I always hated fans (as in extreme fans close to fanatics) from any series. Anyway, I am sure it will blow up in a few days. Also Dan should just not give a ********, Gaia does this for many items. Heck, besides Nintendo it also made from Undertale and nobody complained.

Salt aside, I'm sure that, legally, Gaia is covered. Without having the picture in the OP to compare to, there's 5000000 other anime girls that look.... exactly the same. emotion_facepalm

I like how a whole lot of the responses to the tweet were 'they took your idea!!!11!1!' Dude, ideas have no copyright.

Every time this issue comes up I just roll my eyes. Nothing will happen except for a whole lot of angry people. The tweet should only have come after contacting Gaia and/or his legal team. The way it's handled will turn into s**t flinging fight between the fans on either side. (Or, I dunno, maybe he knew he couldn't do anything so want s**t flinging.)

The design might as well have been parodying this or this.

ITT: people who don’t understand the law saying what Gaia could do that would have made the situation better when it would have then made it illegal rolleyes

This is why I mention west versus east. Queen of Dorks, Homestuck, and now this... Drama. And we have peeps like Hatoful, Cheritz (Korean otome game company of Mystic Messenger, Saeven item), and Nintendo, who all get couple of concerns here and there, but ends with "no problemo".

And please, don't tell me about all this size of company bullshiz (big bro Nintendo versus little bro indie game makers), lol. If we're going to apply legal stuff to one thing, it better be applied to everyone. No bias whatsoever. >_>;

Not trying to hate on the game (tho it seems this Dan guy is a jerk so) but it's pretty much a mixture of anime girls...and at first I thought the game was indeed japanese, not an american game parodying anime, so this guy has no right to complain rofl

Oh no, I totally agree with you! i was just trying to see it from the creators perspective because it's such a non-issue to me. Honestly, it's kinda ridiculous to bust out the e-pitchforks and torches on something so trivial. My point was, companies other than gaia and even individuals make money off of parody all the time.

Off topic, but Gaia kinda introduced me to Mystic Messenger. My sister was playing the game and I wasn't too interested but her avatar here was wearing a Saeven and I thought the companion was cute so I picked it up. Turns out, I've given way more money to Cheritz than gaia concerning the parody item lmao, I bought my Saeven with plat and I bought hourglasses because I ended up liking the story so much. heart
