Welcome to Gaia! ::

I am posting what ThePlanet, host of Logical Gamers (the botters and Cease & Desist-ignoring fraudulent product-sellers), sent me after i sent THEM a ticket

TL;WR - Gaia's Legal Department, you need to actually yell at these morons to tell them to stop hosting LG. My sending tickets won't help.

THAT'S MY FEEDBACK.

Dear Sir or Madam,

Issues of this nature are typically quickly resolved once we receive communication from the content/copyright owner regarding the infringment. We suggest that you contact the owner of this material(Gaia), such that they may provide us with the proper evidence needed for investigation.

This group sells scripts for a forum called Gaia Online. Now, they violate
the following ...

AUP:
Users shall not allow the posting, transmission, or storage of data or
content on or through The Planet Services, The Planet Network or its
physical infrastructure which, in The Planet’s sole determination,
constitutes a violation of any federal, state, local or international law,
regulation, ordinance, court order or other legal process (“Applicable
Law”). Users shall be responsible for determining which Applicable Laws are
applicable to their use of The Planet Services. Prohibited content includes,
without limitation, (d) “spamvertising” sites.

Users may not (i) send unsolicited bulk messages over the Internet (i.e.,
“spamming”), (ii) create fake weblog or weblogs which are intended or
reasonably likely to promote the author’s affiliated websites or to increase
the search engine rankings of associated sites (i.e., “splogs”) or (iii)
send spam to weblog sites or automatically post random comments or
promotions for commercial services to weblogs (i.e., “spamming blogs”).

Mass Mailings – Users may not send mass unsolicited e-mail, which is email
that is sent to recipients who have not Confirmed Opt-In or Closed-Loop
Opt-In in to mailings from the User. *Logical Gamers does not allow people
to unsubscribe from these mass mailings. Gaia Online's private messaging
system does not allow for automated responses AND the content linked at the
end does not allow the recipient an opt-out.*

They violate the terms of service of Gaia Online by advertising themselves
and their product.

4) Prohibited Conduct -- BY USING GAIA ONLINE YOU AGREE not TO: (c)make
unsolicited or inappropriate offers, advertisements or proposals for goods,
services or other commercial activities outside of Gaia, or send junk mail
or chain letters to other Members

Proof that they are spamming messages and violating Gaia Online ToS and your
Terms.

The only reasonable means to resolve this without having Gaia sue your
company for involvement with what is essentially FRAUD is to delete Logical
Gamers and to prevent such a name ever being re-registered.
I would send that to membertalk@gaiaonline.com
The chances of the relevant people seeing this in SF are very slim.

Danke. i was wondering what it was.

Still, feedback stands. Gaia needs to be a LOT more active about this kind of thing. We can't just report the bots, and the host won't listen to our complaints as members.

Gaia does get after them, and they have been shut down before (multiple times actually).

Unfortunately they just spring up elsewhere. It's a never-ending cycle, at least not until some actual real-life in-person legal action can be taken (which would be awesome).

Wow, so the host doesn't seem to care. I mean, you already provided them with the evidence they needed.

And some feedback on your feedback: If you make the font bigger, people will be more likely to read it. I had to copy/paste it cause it was too small to see.

Welcome to the internet.
Here information is law and it can be traded without any restriction.
LG and its members have the right to free speech and to do whatever they want. You're violations are bogus. So they violate the TOS of Gaia they don't really care about Gaia the most that can be done is ban the used account.
The other violations are against what their host? As a member of LG I'm fully aware that we're not in violation of any of those and even if we were we'd not care. Shut us down if you can, does it matter? No, we all know each other we'll just trade stuff via IM. Its all a game for us.
Good day.
Hi Gaia mods

Hi Gaia mods
Yeah - the problem with your argument is that it's infringing upon my enjoyment. For me to have to report your group to its host because they DO violate the host's T&C means i am having my enjoyment of Gaia Online disrupted.

LG's advertising does in fact violate the anti-spamming clause listed in The Planet's AUP. The fact that you come onto our site to advertise activities deemed illegal under the terms and conditions ALSO violates The Planet's AUP, as it's mass mailings and unsolicited bulk messages.

So your TROLLING and spamming in our site without welcome is a problem. It's not free speech when it's invasive and harmful. Take your copy-paste s**t elsewhere.

Unsolicited mass messaging is only illegal when it is a company doing it to advertise a product and profit off of it.

Did I ever say I was?
No, I am not.
I am just presenting my own legal view on this.
Is that a problem with you?

Welcome to Site Feedback. Where we can post our opinions or give feedback. Whether you enjoy it or not is not the case.

And the unsolicited mass messaging is illegal according to two terms of services. I fail to see your point...
According to ToS, yes.
Violating ToS gets your account terminated.
They cannot take down a website because their members keep sending out referral links.

Familiar Hoarder

Actually, yes you can. If they sued, or took legal action.

And if I'm reading the OP/other posts right, its against that website's policy to send out spam pms... so how else is this going to stop?

If you're not suggesting something to aid the OP I still fail to see your point. I don't like seeing I have PMs only to see its the stupid Logical Gamerz site and I have another report against them to file.
