I looked it up, and the age of consent is 18 in my state.
I am turning 18 in a month, and my boyfriend is 16.
I heard that there are legal exceptions if the two people that had sex are close in age. Does anyone have any idea of whether or not our ages are considered close enough?
Also, since our sexual activity started before my 18th birthday, would the law still apply to us?

personally i do not think your ages are close enough for this exception to apply to you... i know 2 years doesn't seem like a lot but just looking at the numbers of 16 and 18 it does look like alot. i think by ages being close is a few months like maybe 6 or 7 months difference.
and yes the law would still apply because he is not 18 or near the age of 18. if you guys break up he can charge you with rape because you are the older of the 2 and also you are a legal adult now.
so please just be careful.
PS this is just my oppinion i would look more in to it if i were you.

If you two have engaged in sexual activity before either of you are old enough to give consent you CAN get into trouble for it. Since you are the older of the two, you could potentially go to jail, have probation, or have to pay fines AND become a registered sex offender for the rest of your life. So, if a fight happens between you, or if your or his parents find out and report it, there is a lot of trouble in store. Even if you are at the age of consent and he is not then he CANNOT legally give consent to have sex. BOTH of you MUST be at or past the age of consent to have sex. So, you should really think about what your doing now, because it can ruin the rest of your life. You need to check the laws for where you live. For example, Canada's new age of consent law has a clause saying teens a couple of years apart in age won't get in trouble, but maybe that's different where you live. If it's not specified or you can't find the information, play it safe and wait until you're both at or past the age of consent before having sexual intercourse. In the mean time, there's foreplay, and you can check out the Alternatives to Having Sex Sticky for other ideas. As B2K said, if you really care about your partner, the risks aren't worth taking. There was an article on the internet semi-recently where an older guy had either oral sex or intercourse with his girlfriend/female partner, who was younger, and they were caught. He's now a registered sex offender and is doing 10 years in jail.

In many states (such as mine, thank goodness), someone cannot be convicted of statutory rape unless the age difference between the two people is at least four years. So in the state of New York, you two would be fine. That isn't the case in every state though.

Thats what I hate about the law. Why should the 18 year old get into trouble for having willing sex with a 16 year old and both love each other very much, its bull crap. You can't rape the willing I always say, if they love you and want to share sex with yo, there should be only two things to worry about STDs and pregnancy.

I can't find any clauses or the like for my state, Arizona. Any suggested searches?
And Valgex, I'm not upset about the laws because they are there to protect individuals from being exploited. Some young people wouldn't know what to do or how to say no if an older person came on to them. I just don't understand why it matters if we are a year and a half apart and started having sex before either of us turned 18...

Most states don't have statutory rapes laws that are insane anymore. You're either going to have to go to the library and look up the laws, go online, or go to your local court house.
My state, Indiana, doesn't have a statutory rape law that is enforced unless parents really have a problem with it. Or the age difference is like..five plus years, I think. Our age of consent is even 16. You can even get married at 15 if you're pregnant, petition the court, and have parent consent. 3nodding
I would be very, very careful until you find out the laws after you turn 18. You are considered an adult then, and he is a juvinile or a child in the eyes of law, thats why it matters. So yeah, you could be charged as a sex offender. It doesn't matter if you had sex before you turned 18, it matters what you did after. You could be in big trouble as everyone else has stated.
