Who is liable for damage due to snow plowing?
If the city plows the roads and tears out one of the large metal reflectors that is imbedded in the road, and this piece (about 9" x 11"
wink is ran over by a truck and spit out by the wheels of the truck and strikes another car going in the opposite direction, who is liable? The roads were mostly clear of snow and no one stopped as they probably didn t even notice it. Unfortunately, the impact of this part traveling at speed along with my cars rate of speed (45mph) resulted in smashing the fender, rolling the leading edge of the door (front door will not open now) as well as blowing out the driver side rear view mirror. Had this gone up 3-4 more inches, it would have impacted the drivers side window. I pulled over and went back and retrieved the debris that hit may car as well as the parts to my mirror. Insurance is not an option as I only have liability (20 year old car, recently restored with book value of about 4K).
