When the police officer confiscates your license you've 20 days before the revocation takes effect. The petition must be in writing and be with a $25 hearing charge, or a sworn statement of indigency. The hearing will occur within 3 months.

-- that the officer had reasonable grounds to halt you;

-- that you're detained;

-- that the hearing occured inside 3 months of your notice of revocation;

-- if you refused the test, that the police man notified you that one could lose your licence; and/or

-- that the chemical test was administered properly, and you analyzed at or over the legal limit.

The only exception to the one-year revocation of your license is:

-- if you have never had a government revocation for DUI before, and

-- if you did not refuse to take the breath test.

If you are revoked for a DWI, it's impossible to qualify except an ignition-interlock license for any kind of licence.

The punishments for driving-while revoked are severe. You will be sentenced to prison for as many as a year (compulsory jail seven days) and may be fined up to $1,000 (compulsory fine is $300).

Once your licence is revoked, it stays revoked till you reinstate it.

Your car can also be "booted up" or immobilized for 30 days so you-can't drive it.
