@Choo: From what the rules state, it seems to refer to the image itself, not a base that was influenced by the image. And she had permission, once again, from who she thought was the artist.

  - this includes scans, screenshots or other similar images, even if you took the screenshot yourself or bought the book/magazine etc that you scanned the image from, you STILL need permission.
  
  - this also includes sites such as animewallpaper.com or animerender.com. You need the permission of the artist/company that owns it. Just because it's free to download does not mean you can make a profit off of them.
  
  
• Use stock images without permission from the person who took them.
  
  
• Use any photobucket, google or other similar images without permission of the artist/company that owns them. Asking the person who uploaded it does not count as they do not have the authority to give you permission, unless they made the image themselves.
  
• Use traced, copied or eyeballed images.

I think everyone hopefully understood that part. In the end that wasn't the standing issue.
What was standing is that it might have been a misunderstanding. In the anime galleries she may have been given permission, and not have realized that the person giving the permission wasn't the true artist. It's still highly plausible.
The TOS won't cover that, so what you have to decide as a member is to let them know what mistake has been made, if they do not correct the mistake, then you should take action. Such as filing a report.

I honestly don't understand what the problem is.
She's just using the image as a base, she's stated that she did not trace the image. Whatever she does afterward is going to look completely different from wherever she referenced anyway.

She has also said that she'll change the pose in some way.
Why are we even still discussing this?

you shouldnt WANT to report her, she was TOLD one thing, and It happened to be something that can get her in trouble. SHE DIDNT know cant you get that threw your THICK skull.. She ALREADY stated she WOULD change it, and NOT use it... LEARN HOW TO READ, instead of JUST arguing!

First of all. I'm sorry to Cy, Bishie, and Yoku who had to suffer through this.




What everyone should learn is to get all the facts, and take action when appropriate.

Yoku has promised to change it since she now knows it's stolen. That on it's own is a good sign and shouldn't be misread. It ends this whole ordeal.

It was good for it to be brought up, since now if she complies and changes things she won't get in trouble.



Well then. I think it's safe to say we can kindly move on.
I have no personal feelings of anger toward Choo. I don't think anyone should truly. She was indeed making valid points. I just hope she sees more than rules in the future, and then properly places them.



Now then. Someone who is part of this auction should set things off in a new direction. ^^

I'm dropping, I already informed Bishie. Thank you to everyone and I apologize to all those involved, I will be more careful with my art next time. This has just been too much for me in the end and I'll probably avoid all art related stuff like the plague for the next few months. Good luck with the auction and all your art.
