What are your views on gay marriage issues being only left up to the states in America?

I personally believe gay marriage should be legal but decided by states. However I also believe that a federal law forcing a religious ceremony is unconstitutional.
On the flip side if a gay couple can find someone to wed them they should not be denied by law.

My stance
Leave up to states
Separate legal and ceremony
Ceremony can not be forced by law
Law can not prevent marriage so long as everyone us willing

The first one is my basic stance but the next 3 are what I think the states should do.
If States were allowed to decide on civil rights I'm sure most of the southern US would've kept segregation and Jim Crow well into the 80s, if not 90s.

Mississippi recently wanted inter-racial marriages to be illegal. I think that there'd be more tha just that, there would have been a reversal in a few states making slavery legal again.

It shouldn't be decided by anyone, it's unconstitutional as it stands now.

I have a lot of good, legal reasoning for this. I'll share it only if you want a page full of stuff to read.
Leave up to states
Civil rights should not be left up to the states. The whole point of civil rights is that they are our natural rights.



Separate legal and ceremony
It is already separated. A person can be legally marry without the rite and a church cannot be forced to marry someone.

For example, the Catholic church has routinely denied Jews and Catholics from getting married. They can get married, but not in a Catholic church.

Washington's working on that, since it's guaranteed that the House will pass the bill legalizing same-sex marriage.

Well, upholding a civil rights measure through popular vote anyway, since 55% of the population says they'll uphold a law like that if it's put to a referendum vote.

This issue is actually very interesting.

You see, due to the nature of the United States backwardness and culture war (Progressives VS Regressives) there will always be more of a push for a centralised system as opposed to a federal system. This is despite the fact that the United States is a federal system (10th ammendment and all that jazz). This is primarily because there is a fear amongst Progressives that the bigots and backwards people will vote to place restrictive and oppressive laws on the minority. Thus, a centralised system is seen as necessary in order to protect the minorities from the radicals.

In Canada, the federal government usually trumps the provincial government but in many cases the provinces are often given more powers than the Americas states.

Since there is no culture war in Canada, there is no fear that comes up when the provinces are given more power. If we had a 10th ammendment over here there wouldn't be as many worries because over in Canada we don't have a culture war going on. This is despite the fact that there are so many different people in this country. It's interesting really...

It's never really going to be an argument about federalism as it is goint to be about the backward people vs Progressives.
Hostility here is odd given states have been much more inclined to legalize gay marriage than the federal government has ever been.
States should only decide on the matter if they're going to decide in the same manner that I would like. If that isn't the case, it's should be a federal issue, provided that the federal government would decide on the matter in the way that I would prefer. Failing both of those options, it should really be left up to the courts, in the event that they would agree with me...

...and if I'm out on all three counts, I'll wait a while, and try it again later. 3nodding

Civil rights should not be up for popular vote.

If it worked that way, I guarantee you that my ******** up home state of South Carolina would still be a no-women-voting, no-interracial-marriages, "slave state".

The majority doesn't get to vote on the rights of the minority.

And a religious ceremony to marry isn't required. Marriage is a legal contract.
1) it is up to the states (in fact, the FF at the CC stated that it was a quintessential local issue)
2) nobody has ever questioned that
3) the states still need to adhere to the 14th (note, I think GM bans are Constitutional under it)

It's unconstitutional to not allow gay marriage. So it's been decided. Even CANADA allows gay marriage. Come on people! Let's get with it!
