Extend that line of thinking.

The people ellect the green party canadent for president.

The courts overrule it and keep obama, because the green party isn't a legitimate party in the congress. Or because it's a 2 party system and there can't be a 3rd party. or something just as stupid.

Courts can only review under the scope of superior court cases (lower case, not capital) or constitutional law.

Quote:

And they would cite the prop 8 case as president.

It's a state court, sweetie. It's only binding in the state of California, it's non-precedential for anything other then California cases.

Quote:

Think things through. You are willfuly bending over and letting the courts take power away from the people because the courts think the people are wrong.

Well, technically; the courts are keeping the people from taking rights away from other people. Horrible thing, that. /sarcasm.

Iraq 2.0. Don't come crying to me when you are ordered to town square to reciet the pledge of alligence 5 times a day, or something equaly retarded

Yeah no.

I don't be mean here, but the crux of your argument seems to be: "I don't know how the court system works, and they might do something bad in the future!"

Again, judicial review has been around for two centuries give or take. If someone were to use it as a tool to seize dictatorial power, you'd think that might've happened at least once by now?

I just do my best to never forget anything ever. I refuse to be a slave to the Wexis over-lords! Cast off your shackles and join me in my Luddism!

Okay actually I totally love WestLaw for journal search. And heart AmJur. But mostly journals, though I think Hein Online is even better there.

I have no strong opinion on KeyCite versus Shepherds.

Well, I'm in school and they pass Lexis passwords out like candy. What is it they say? The first hit is always free? xD

Ok, if your "certain principles in our consitution that conflict with your perferred outcome" have been there for decades.

Why has gay marriage only come up now?

Why not in the 1800's? 1900's?

Hey, remember when I linked you to that summary by Liz? And suggested you read the opinion yourself? This is another case where doing that would answer your questions and make you look a bit less silly.
Quote:

Your reasoning is disgusting because you don't want to seperate the "gay rights" issue from the government power issue. I'm not argueing against gay rights,

No, your majoritarianism is just plain opposed to anyone having any rights at all. That's exactly the consequence of what you're advocating.
Quote:
I think they should have all the same rights as straight couples, just don't call it marriage, because marriage has religious meaning. Call it civil unions. My home state of WA already has it, yet the "gay rights" lobby is pushing for the title marriage... And there are groups that are promising to use the inititive process to counteract the state government.

Helloooooo pure animus!

Quote:
Are you going to tell me, that without the consitution having changed in atleast the last 50 years, that there is a brand new line in there that gays have the right to marry?

Again, read the damn opinion before complaining.

[Editor's note:
The rest of this post was also stupid, and didn't really say anything of substance -- so it's been replaced by a link to the Hamtaro theme. I think this is a substantial improvement]

Actually, Perry is in federal court now, it's just the opinion didn't hold there was a right to marriage or half of what he imagines it contained.

Also, I would think it'd be difficult to rule that a document won the election, even if the Court did go mad with power.

I stand corrected. I must now perform the dance of not being precisely, precise, as is the custom of my people. xp

Sadness! The sort of area where the only place people spend more time in than bars, rodeos, churches and hunting stores is Walmart?

A friend of mine who worked the night shift at Walmart once described the situation as such:: The mullets are out in force.
