I have a question regarding using other artists' images in a commissioned profile. A potential client of mine believes using this: http://photobucket.com/privacyPolicy is valid enough for permission to use images from off photobucket on a commissioned profile.

Is this allowed or should I tell them no good?

that contains nothing about whether or not people are allowed to use the pictures uploaded onto photobucket. o_o

I make my own wallpapers and other images-100% from a blank canvas-without any direct referencing of another artist's work, as well as no use of anyone else's textures, brushes, ect.

If I were to order a banner or something of the like, and gave a person my permission to use my image for this purpose alone-how ever many times I want my image used-

Would it be wrong that they made gold off my art, just because I wanted them to use it?

if you gave them permission that they're allowed to make gold off your art, then yes they are allowed to use it.
but if you were vague and the other person did not specify that they were going to make gold off your art, then maybe there needs to be some rediscussing .

if you gave them permission that they're allowed to make gold off your art, then yes they are allowed to use it.
but if you were vague and the other person did not specify that they were going to make gold off your art, then maybe there needs to be some rediscussing .

gaia put that rule, saraum because of legal issues.
people put up images for FREE USE. meaning you're not allowed to sell anything with their pictures in it.
since this is personalized graphics, we're technically SELLING their work for our OWN gain.
we're asked to get permission from them because of the fact that they can actually sue gaia for OUR mistakes.

so think first before you go around bashing gaia's rules.

This is also why it should be made very clear by graphic makers in this forum that all images created on Gaia are SPECIFICALLY for use on Gaia only because alot of folks may get images by googling or just surfing and some might be copyrighted but really not many pay attention to that or might even know its copyrighted unless it bears a watermark.... i myself get my stock from istock/mem imgs (paid for) but i do use free brushes from around the net and Dev art and other free sources for fonts/vects and such and some you cannot give credit to the owners because its not stated who the original creator is. But i don't think that Gaia can be sued for this as its not their doing and with millions of users Gaia cannot be held responsible for checking every little detail. It is still however up to the designer to use their judgement on whether using an image is violating the t.o.s
Can I use free stock images from other sites? (just wanted to make sure)
