Well, my question is, how would I give credit and such if the image is a screenshot from a movie? I changed the picture a bit, adding effects, text, etc, but I know it's still not my photo. So how do I make sure it is 'legal' or whatever, so It can be put into the profile? Because I plan to commision someone to do a profile, with this image as the top picture.

Would I contact the film company to ask to use it in a profile on a site or something?
It doesn't seem like that's what everyone does when they make a profile with a public image on it.

Yes, you would have to contact the movie producers/owners and their copyright company to receive written permission from them in order to use anything taken/screenshotted from their movie. This is if you plan on selling profiles with such images. heart

I am planning to open up an AMV shop and I am kinda wondering if that'd be okay. There isn't another one so it's not like I can see how they are doing.

Basically what I plan to do is take requests on making an AMV in exchange for gold ((200-400g; still deciding)). An AMV is an Anime music video, for those who don't know ((surprisingly alot of people don't know that)) in which I use clips I download from the internet and place them together with a song in Microsoft Movie Maker. From there I upload them to a video uploading site and let the requester know it's finished.

Still unsure? Here is a link to a website where I have a few AMV's posted; don't plan on using that one to uploading the requester's AMV's since you can only embed videos from Youtube. ((Can't stand them and Google!)) And don't worry, I made those a few months ago and placed them on Youtube, I wouldn't embed anything I didn't make myself.

Don't want to be breaking any rules; I love Gaia too much to do that. So basically my question is if I'll be breaking a rule if I use anime clips and a song. Technically I consider this parody stuff, and parodies aren't blocked by copyright infringement laws.

Yes, you would be violating both the Mini Shops rules and the Gaia Terms of Service. Anime images/clips are commercial artwork, and you would need permission to use any such images/animations/clips/videos in sales. Providing copyrighted materials for Gaia property is also a serious violation of the Terms of Service, and is not tolerated anywhere on Gaia's servers.

So in short, no this is not allowed. And yes, it would get you in trouble. heart

Unfortunately, yes. You do have to provide credit to any outside sources that you use. Some brush sites also don't allow people to use their tools/resources for commissions and profit.

If you do not have the links to the brush-sites any longer, I would simply advise you to not use those brushes. 3nodding heart

Ah, no. You would need to find the individual makers/artists and link to them, instead of linking to DeviantART as a site. 3nodding

Ok, that's understandable.
What if I am giving it to a shop owner for a commision?
Would they need to get permission, would I have to?
Or what would have to happen?

I have a question i want to make a shop that has custom comic and cartoon logos l haven made it yet and i was wondering if it was allowed.
For example
I have silver and gold superman logo, a green and purple transformers logo i draw them free hand

Are you allowed to use lunapic.com to put an animation together?
Like, I would make 5/6 different animation slides on photoshop, then I would go on lunapic and put them together to make an animation.
Or is that not allowed?
I would say a simple animation is ok, but any of the more complicated ones like the Hearts Animation would not be ok, as they are more like generators which aren't allowed in Mini Shops.

Uhhh.... What about render sites? i.e Planetrenders or GameRenders, where people get permission, render the object, and put it up for public use? It's where I get everything, and I wanted to open a shop, but if this isn't available....

Wow, the Copyright Infringement sections are really being crazed out here. I think I posted once before, but I guess this would be the best place to discuss it.

I'm a Web/Graphic Designer, and 3D Animator by trade, Professional and paid. It seems like the laws are so strict around here. I mean I can understand plagurism is a big deal, and infringement as well. but How can using or selling something you made based on something that is a copyrighted show, comic, or art illegal to use, when you are paid in Gaia Gold, hence not true currency. It's more of a trade like you would copyrighted baseball cards for a pack of gum. To sit here and gain permission from the creators of Buffy, Final Fantasy, Sailor Moon, or any other copyrighted material for use in selling or editing on Gaia is absurd it seems. The Law states you cannot use for sale. Only strict artists and designers would copyright something so you could never touch it.

Infact if someone can't make a banner from a Artist's artwork or a TV Show, there's over 20 registered guilds that would need to be investigated and shut down. Final Fantasy 7 Guild portrays a picture of Sephiroth from Advent Children (Sorry Fellas twisted ) Matrix RPGs can be found with the Kenji Code Source, that is copyrighted. There's a Buffy RP that displays the use of the names. Star Wars Guilds, and so on. If things are truly strict on people displaying banners in their shops, that are edited from these copyrighted resources, then 90% of the shops, Guilds, and Signatures would need to be removed asap.

None of which are being profit by, atleast with Real money. None of which are being used in disrespect of the original artwork, show, or person/s. In addition it's advertisement for them. Sure some arrogant artists or designers will fight it, but the majority wouldn't mind as long as you aren't pocketing their money.

I personally obtained the rights to build sprites for a group, of Final Fantasy. It took me 6 months and $500 to gain sourcebook copyright permission from Square-Enix. On top of that, one of the Lead supervisors from the Final Fantasy 7 game (Translated in English) stated "You didn't have to do that, but we appreciate the honesty and legal standards. We don't mind people using our sources as long as it's nonprofit. Heck you can make your own version of Final Fantasy sell the characters alone, and just use the name without selling the Final Fantasy Products."

Now Nonprofit stands for Usage without the means of payment in currency. Gaia Gold is not currency. It's the same as buying a card for time on Everquest or any MMORPG. It gets to things in the game and cannot be exchanged for money. So isn't this all nonsense? Maybe I'm the only one who may not understand the full reasons here. But if I couldn't open a shop to sell Superman sprites that I designed because of copyright, then Those guilds would need to be removed as well as signatures, banners, and so on. I just thought I'd throw in two cents, I might be out of line speaking of this. I love Gaia, but this Copyright stuff irks me. stressed


I just felt like this had to be brought up again, because it is a good point. And what are we supposed to do if we weren't blessed enough to be able draw decently? Just hope that somewhere along the road you stumble upon some rare item to sell? Have fun waiting. Most of us wanna open up shops so we can do things we enjoy and have some sort of incentive, in this case, gaia gold. Thus I do not see how gaia gold is grouped in with the "exchanging for profit." Being as I cannot go to the bank and say "Okay, i'd like to get this in Gaia Gold, please." They'd probably look at me as though i was crazed.

It's rather disapointing. I think that the artwork was put onto the internet for the world to use and see. Is it any different if you have a picture you don't own in your signiture? No other sites have this regulation and I find it a tad to restricting. I doubt the artists or owning company would care anyways. I mean isn't using there graphics giving them more publicity? I mean if I saw a really cool anime based profile I'd want to go buy the manga or watch the show. But I guess I don't make the rules and I'm not in any position to break them.
 
     
 
But what if someone wants to pay you to make them fanart? Like, persay, a Sora or Sephiroth or Cloud banner? And besides, Gaia gold is free anyways, so basically, we're paying for fanart with fake money. That's like taking a copied CD and giving it to a friend for money they drew on notebook paper in english class. That's not making a profit either. That's giving someone a gift and having to throw away their trash. XD Okay, bad example, but it's true. Gaia gold has no affiliation with real money. It's not making a profit for anything but to dress up your little pixel person with fancier pixel stuff. That doesn't make any money for the person. If someone was selling it for Gaia Cash, I would understand, but this just doesn't make sense to me.
All I know how to do is rendermanipulation fanart. I'd love to sell my services, but because of these restrictions, I'm basically up a creek without a paddle. I just don't understand the problem. What am I supposed to do, email Square Enix?! "Dear Geniuses, could I have permission to use images of your characters in siggies that I will sell for worthless Gaia gold on the internet that can do nothing but buy little pixely pictures?" They'd just laugh at me!

I will follow the rule, but I just want to make a statement regarding this rule. I know you are doing your job, protecting the rights for the people who made it first. However, there is some problems with this rule. It is not going to stop everyone. It is not going to make that huge of a difference. All Gaia is going to do is hurt themselves in the long run. If I am wrong, then I am wrong. Please don't ban me because of this. I am just stating an opinion.

Your full rule confuses me to no end. I try to compare it to other sites and I still don't get what you mean full permission. For example:

Ebay is just like Gaia when we make shops. People have items such as a movie or anime artbooks and when they don't want them any more, they sell them to make money. Some people have bunches of the same thing. They almost have a small shop. The only major difference is that the people on Ebay don't have to contact the original owners. This is because of a "Fair-Use" law that is known throughout the world. Credit is required as long as you don't claim that you made it first.

My question to you is this: Why are you so determine that we get permission. If you don't want us to use any graphics, state NO GRAPHICS ALLOWED. That would end the confusion of this new rule.

If I get banned from Gaia, please let me know the reason. I am just stating an opinion. That shouldn't be against the terms of usage, right?
