Umm.. Are you allowed to maybe make a free profile for someone using images instead of charging gold?


Its really only when selling that these rules applies.
When making graphics for free you are not that limited
to what images you may use. I would however recomend
always asking someone before you use their work in something...

Unless you drew the fanart yourself you need to ask for permission to
use the art from the person who made it.

Question. I have someone who took a picture from Google which is a simple icon of a sun. They inverted the colours and enlarged it to make it as their own personal "logo" and now, they just requested a profile from the modified picture. Am I allowed to make one with this picture?

Although it may seem harmless to you an image like that but,
like they state in this sticky, you always need to know who's
behind an image and get their permission.
While you're still alive, try and appreciate it by living your life to its fullest...


No worries, then. I just told my customer to either get a permission or just make an original logo themselves. Thanks. ^^

Question.How do we know we got permission or if you know the person has permission..
My question is the same as Hoshi we can e-mail them a request but that doesn't mean that they will respond and its not always the same reason as a blunt "that means no" sometimes people just don't respond in general so you can't get a response. Either way, some times even just chatting people won't respond to questions or requests by another.

And if we did get an okay through some way of responding how would you know that we got the permission? Such as Graphic Designs for layouts or banners, we would be using characters or art that belong to another company if we got permission then how would we prove it to you? Using a link from an e-mail doesn't really have any proof if you think about it with hackers and spammers. There are tricks and 'loop holes' for fraud e-mails that people would discover and use.

Or say if we didn't get permission/didn't ask for any; what if we created the banner/layut, etc. item but instead of selling them give them away for free.

Like, I can edit pics ppl want them to be edited and it costs some gaia gold?? is that ok???

You can ask customers to post screenshots of posts where artists
approve the use of their art/work. Or screenshots of emails. 3nodding

Lets say you email a company that owns a certain copyrighted image or character.
If they dont answer I would take it as a no. You need an answer - an actual: "yes its ok to use" for it to be valid.
You always need to contact the proper artist or company that have the actual copyright of the work.
It can be tricky from time to time to figure out who that is.

Getting the proper permission only applies to when you are selling graphics.
If you are handing out things for free its pretty much (but not always *) ok to use any image or art.
But then your shop would belong in Art Freebies wink

*some artist - like on deviantart - dont want their art/images used in any way without them knowing. No matter if they are free/used for personal purposes only

No. Not if you use copyrighted images that you dont have permission to edit and resell.
If you just intend to edit pics people provide you with that they took/made themselves - then it would be ok.

    Assuming they're in the public domain, it should be fine. But you should do a bit of research to make sure they actually are. Public domain images can be used for profit. smile
You know what? This is an absolute joke. I just had my thread deleted because I displayed an example of a graphic I can make on my shop thread. I wasnt SELLING THE GRAPHIC at all I had it for display purposes. Does Gaia have any idea how much effort people put into their threads? Ive just had mine deleted for no reason at all to be honest. Last time I checked putting something as an example isnt SELLING it.
