I am at this time attepmting to get someone to do some more different avatar work done for me. These will be for one of my threads which really doesn't matter now, but it will feature the faces of avatars which are not mine, do I
A. Have to ask there permision to use there avatars, when I will be commisioning it out to someone and then giving it to them free?
B. Do I also have to ask there permission to post it on the thread?

If the avatar is Gaia's then you don't need permission as the admins of Gaia have already given permission. You will be free to use them and post them.

i always wonder if i should report shops where i see that the creater use graphics especially anime scans which are not fan art ...

i dont want to become a bad image that i am evil .. but on the other side its against the rules to use this images for sale .. so what should i do?

You can kindly remind shop owners that it is against the rules and point them towards the rules stickies, either by posting in the shop or via PM. If they ignore you, then you may report them via the report system. 3nodding
What about if the customers gave us the pictures? confused
or if there is no certain or clear 'copyright' attatched to them?
And if we don't charge for the picture, but for the work we've done (editting)?

If the customer gives you them, then you would need to check that either you or they have person to allow you to make a profit out of them. The answer is the same for the second question, if you cannot get clear permission from whoever made it or owns it, you can't use it.

Charging work for editing something is also not allowed. If I had a drawing and I saw someone edit it, I wouldn't be happy that they are making money out of my work... even if it is just virtual currency.

I take an image from google. In which I believe all google images are NOT copyrighted, unless stated otherwise. That is, because they are the origonal images. However, if I use a picture from google, edit it, change it, transform it into something else... Am I still allowed to "sell" it, as you say?

    ยป Images on google are not copyrighted to google, but actually copyrighted to the individual artists or their selective companies. This is why it's advised to not use images off of google, because there is no certainty to who the original creators are.

    Chances are you'll be redistributing images that were put on Google without the written consent of the owner. And selling these images could get you in trouble. <3

    So, in short terms, no, you are not allowed to sell it. You can edit them, change them, transform them to your heart's content and give them away for free, but selling them on Gaia is prohibited (unless you receive the permission of the artist).
Why is giving credit to the author/artist for his work necessary if you have the copyright to that image?

And why do I have to have permission from an artist for an image he drew for me to use it on say...A profile?
I have 2 questions which may sound stupid.

#1. If I would use WWE pictures would I have to credit someone?

#2. If I had a lotto, could I have a Naruto profile as a prize to whoever is dedicated to the lotto the most.
I have a question.

Am I allowed to use brushes that I did not create to make signatures to sell for gold? For example, suppose I used brushes that I downloaded from Deviant Art.

As far as I understand this means you can't do your own interpretation of a copyrighted image? Not by tracing etc, just putting your own spin on a picture from, say, Berserk.

Jacko Vance: If you have the copyright for the image, it is still nice to put down in writing that you have it to avoid other people confusing you with stealing art. This is applicable to artist who give you their own work to use, just a short blurb saying "This artist gave me permission to use his work in his profile" etc.


King of Games 1:
#1 If you're using any images you don't own, you would need permission from whoever owns it if you plan on selling for Gaia gold. If it's for free or personal use, then you don't need to credit, although credit is nice to give.
#2 If those entering the lotto need to pay to enter, then a Naruto profile is not OK since you are in effect giving them something that's copywrited in exchange for the gold. If the lotto is free to enter, then this is OK.


Magicookie: Yes you are allowed to use brushes, but please credit them if you can ^_^


Inguz: Eyeballing means copying by eye. If you were to put your own spin into the picture, say add accessories, change the hair, add a detailed background, then this is OK. Having said this, people would pay more for original works of art and it can be frowned upon to have a similar look largely similar to an official artwork.
