If the image was something they drew, then yes that's OK. But if it's not, then no, you would need permission from the copyright holder or the artist that drew it.
can i plz ask is there a site that has i thing that teaches you how to make thoses banner things i seen people make alot of them!

I would just like to say, that I was accepted into a private art school just recently, and in my portfolio I had graphics that I had created with aid of some copyrighted images. None of the proffesional staff cared, because I wasn't claiming the base images as my own, they were just one tool in a process that used several different tools.

Getting into college is a much bigger profit than using these graphics to increase my simulated currency on this website. I just think it's absolutely abhorrent that this place holds itself to such an unjustified esteem. 'Selling' image manipulated graphics on this website for gold is no more illegal than exchanging a doodle of Ash Catchem for Monopoly money.
If you mods want to, you can ignore the following part up untill the next red text where I have another actuall question(s).

I've been accepted to college just recently too. I'm going to FIDM, the Fashion Institute of Merchandise and Exchange. In order to get in you must go to an interview. If you pass, you must do a project related to the major you wish to take for the second interview. If you pass that, you're in.

I used BOTH Hot Topic and Nightmare Before Christmas in my project for Graphic Design. (They said to create a bag, a poster, and a magazine cover for an imaginary store or real store.) They were so impressed with my work they asked if they could keep it to put it on display on campus in Irvine.

Having used those images I'm 99% guaranteed that I will make ALOT more money than I will have if I didn't go to college.

How is Gaia "points", which is all that gold is, going to help me do ANYTHING but get more GAIAN stuff? Maybe some art from someone else? Big deal. Go to any Anime-Con and people do that with REAL money.


Okay more question(s).

1. What about a "general licence" for Gaia? As in permission from a company that states that anyone on Gaia may use images for whatever so long as they are only traded with Gaian gold and items? If someone obtained that, would you honor it? (And again, how would you know if it was faked or not?)

2. Have the admins read this entire post? I am NOT saying the admins are stupid or anything, as I think they're pretty f-n smart to have to create and maintain this site, but sometimes an outside point of view helps. If one group on the planet decided everything behind doors without ever listening to anyone else the world would fall a part fast, am I right?

Note: I'm not asking these questions to piss people off or anything like that. I honestly want to know an answer. Because they are your rules I should be able to recieve an answer to any question I have about them. It's the duty of those in charge to tell those they're governing any aspects about the rules they may question. (Example: Awhile back in GD someone was really pissed because the queen of England "owned" all the dolphins around the UK. Someone else pointed out that is probably to protect them from poachers. You see, unless the people know everything they want to know, they misunderstand and feel mistreated. That is why I'm asking so many questions, so please don't be upset with me. >.> wink

Logic.

For example: "Why is milk good for you?"

This person would like clarification on the health benefits of milk. A preferable answer could be, "Milk contains many nutrients which help the body grow and function properly."

Clarification has been given in the form of an answer. Answers are given in response to questions. I asked questions. I asked "questions for clarification."

I want answers, please.

As I did not see this answered earlier, are brushes allowed to be used in the creation of sigmaps if they were not created by you?

And I was reading the original rules in MiniShops but because I want to be sure, if someone gives you art that was drawn for them by an artist, are we allowed to put those into images, or must we ask for permission from the artist?

As long as the brush site you obtained these brushes from state in their Rules that you're allowed to use them, yes. <3

As for the art; it's always safer to make sure the artists have given their permission to use the art. So, ask your customers to show you proof of the artist's consent. Or PM them yourself. That's the best advice I can give you. ^^

As long as the brush site you obtained these brushes from state in their Rules that you're allowed to use them, yes. <3

Okay, I'm still really confused about all this. In my pathetic little shop I have graphics that have KH2 chars and some charas from two anime (and these dolls from this site...), but seeing as they are samples, do I need to contact the creators about this?
*And not to be rude, but I somewhat have to agree with the arguements thrown out there and the rules are a bit of a contradiction to a majority of Gaia itself.*

1. If a company did indeed give a general liscence to a user, then it would be best for us to see it and if it proves to be legitimate, then yes. This is similar to the way the admins have allowed all Gaia users to use their graphics, in effect a general liscence that we do currently uphold.

2. Yes, we do not make any rules without discussing it with the entire staff, both moderating and admins.

Samples really should reflect what you're going to sell :/
I suggest you make new samples (preferably) or make a statement that you will not use images without the artist's permission.

okay.. I have a quick question...

You said we can use fanart we have done ourself, but not images that are eyeballed.


So if I drew a Sailor Moon pic in her classic Sailor moon pose... what would that fall under? I mean, it could be argued that it is "eyeballed" as a classic pose rarely changes... but then again, I drew it.. it's fan art... and you don't really have any proof I was looking at an image when I did so.

I'm just asking because I do a lot of art (for fun, I haven't started selling any yet) and I have different sources of inspiration. I used to get a comic magazine, (Wizard, I think) because it gave me ideas for things to dow ith poses and hair and outfits and stuff. They had a debate in one issue as to whether or not one picture was a rip of another... and the images looked similar... but again, there was no proof one artist had looked at the other's work.

It's a grey area, and I'd like to know so I don't accidently cross some line, if one of my pictures looks like something someone might have done somewhere else at somepoint in time.
I won a competition allowing me a free custom profile which I can choose images for so does that mean I COULD use an anime image to put in it from google as the person making it isn't making a profit from making the profile?
I know this doesnt nessasarily have to do with stolen images or whatever, but a have a wishlist shop/thread and i found another thread that just opened that is also a wishlist shop, and i checked it out and it is just like mine! like she actuually copied and pasted several of the paragraphs that i posted in my wishlist shop! word for word!


is that legal???

could that be considered as plagerism???????
