A $500 fine and up to a year in jail, that's the penalty that Jared could face, now that a judge has allowed the prosecution to move forward with it's obstructing an officer charge against him.

"Me, I'm more of a fighter and so is Jared and eventually we're going to get through this," Jared's father Allen Lardieri said. "I don't think it should have ever gotten this far."

The Logan County Police Department initially claimed that the at-the-time 8th grade Logan Middle School student was arrested for disturbing the education process, obstructing an officer and Lardieri says that officers even went as far as threatening to charge Jared with making terroristic threats.

"In my view of the facts, Jared didn't do anything wrong," Ben White, Jared's attorney said. "I think officer Adkins could have done something differently."

Prosecuting attorney Michael White refused to respond to any questions, as did Logan Police.

We obtained official court documents from both sides of this case. On one hand, the arresting officer from the Logan City Police Department, James Adkins, claims that when Jared refused to stop talking, that hindered his ability to do his job, hence, the obstruction charge. On the other side, Ben White points out that nowhere in the arresting officer's petition, does it mention Jared ever making any threats or acting in a violent manner.

"Every aspect of this is just totally wrong," Lardieri said. "He has no background of anything criminal, up until now and it just seems like nobody wants to admit they're wrong."

Ben White says he will continue working to have the charges against Jared dismissed. If that doesn't happen in the coming weeks, Jared will be back in court on July 11th.

Nothing said he was yelling and no, the school is not in the right because zero tolerance policies are bullshit. Having a picture of a gun on your shirt, especially when it's a shirt for an organization, is NOT going to cause some kid who sees it to go crazy and kill people. If the shirt was actively threatening that would be different but it wasn't.

My school didn't allow any shirts with weapons, pornogrpahic mateiral, ect on it. Maybe it's the same over there? I don't think it's even a zero-tolerance s**t in this case. Could just be something in the handbook.

Meh, I'd assume it was yellin or something. I guess even if it was talking it'd still be hella distracting.

The gun policy at schools are ridiculous as s**t. No one is going to become a flipping axe murderer if they bring toy guns to school, just like no one is going to shoot up a school if they wear a gun shirt to school.

The school is not right, because it's a freaking shirt. That's all.

That s**t used to happen in my school too. S: Some teachers don't really care and others do. Usually the teachers that do have the stick up their asses are in the right, though. Though I guess it'd just depend how open minded they are about said shirt.

AGain, it just depends on what they allow and what they don't allow. Back in elementary we weren't even allowed to bring any toys whatsoever.

Anything can be a weapon. It's how you use it that determines that. Would your school have allowed a shirt with a bow and arrow? What about one with a sword? This is most likely a zero tolerance gun policy that doesn't allow any depictions of guns anywhere which means you can get suspended for forming a gun with your hands or drawing something vaguely gun like on a piece of paper. These policies are idiotic and brain washing. They are not meant to provide a safe environment but to teach kids that guns are bad.

Don't assume. Especially when the report doesn't say yelling. The issue is that he could go to jail for it. Which is stupid. I could agree to a fine and maybe a little community service but jail is idiotic for such a small offence by a child. They just wanna throw the book at this kid because he supports gun rights and the NRA.
