The first week of its release didn't count towards the scheduled evo time.

If I buy a Modus now (not the second) and wait until it evolves, will it stay Modus or will it get bumped down to the second generation?

It will stay as Modus Operandi. No gens and not bumped down to 2nd gen., plus 1st gens have the fresh and new poses displayed in the EI report.
